Knowledge, as an invisible element of production, has become more and more important to the economy, moreover the level of productivity is related to the overall development of the national economy. Patent as a form of intellectual property, its value is not reflected in the ownership of the patent, but in the implementation and transformation of the patent, which can bring about commercial value. Due to the production process of the pa tent has to consume a large amount of social resources,If all kinds of patent achievements created can not be transformed and return to profit, will reduce the innovation and enthusiasm of the main body of innovation as well as the initiative of enterprises and other main transformation body. On the other hand, If the implementation of patent transformation is not so smooth that innovation achievement can not be carried out in a timely manner, which will cause the stagnation about industrial technology up grading. Therefore, the effect of patent commercialization will become an important issue that restricts the independent innovation and industrial upgrading of China’s industry. At the same time, compared with the world’s major developed countries, there is still a certain gap between our country’s patent commercialization: The ability of science and technology transformation and the speed of economic development are out of line. Under this background, speeding up the transformation of intellectual property rights in china has very important significance, which is helpful to improve the enthusiasm of innovation subjects in our country, cultivating the consciousness of patent transformation, strengthening the ability of enterprises to create、 manage、protect and use the patent, In order to promote the upgrading of indus trial technology, and comprehensively enhance the core competitiveness of enterprises, etc.This paper first points out the importance of patent commercialization in the introduction,combed the policy status about domestic and foreign patent commercialization and explained the ideas and methods of this research. In the theoretical part, described theoretical basis and related concepts, four influential factors of patent commercialization policy are established, including technical factors, market factors, service factors and institutional factors. In the third chapter, analysis the policy on the commercialization of patents from 1994 to 2015, which have been divided into two categories: policy of supply and the demand. Using content analysis method to analyze the relevant policy and combined with the current policy effect of China’s patent commercialization, discuss the problems of policy. They are the lag of patent information and trading platform, the disconnection of the industry-university-institute cooperation, the risk of the transformation of scientific and technological, the blockage of patent commercialization channel. The fourth part is to analysis of foreign patent commercialization policy, and obtains inspiration from it. In the fifth chapter, the author gives some suggestions on the improvement of the patent commercialization policy from three aspects: the policy body, the policy tool and the policy content.
