As the crucial factor in contemporary globalization competition, innovation capability has become the focus point for new period China. As the only way for developing countries to seek for leapfrog development, technology import not only is the method to obtain advanced technology directly, but also through technology spillover effect to realize technology diffusion. Intellectual property protection, as a more important international business rule be in common use, is the system requirements and legal protection for carrying out the innovation activity in a deep-going way. Technology advance and intellectual property rights protection not only can influence on innovation capability separately, synergistic effect of both but also can play a further role in the promotion of innovation capability. Meanwhile, the difference of industry and range condition also can bring a different result and discussion on the problem whether technology import and intellectual property rights protection can motivate the promotion of innovation ability.Based on the above analysis,this paper conducted empirical test on national and regional samples by using the panel data of high-tech industry from 26 provinces during 2000 to 2014. The results showed that: from the general and regional perspectives, intellectual property protection plays a significant promotion on the enhancement of innovation capacity; while the role of technology import toward innovation capacity enhancement has significant regional differences; the synergistic effect of both technology import and intellectual property protection is limited by regional technical trading levels; furthermore, R&D investment plays an significant effect for innovation ability enhancement, and the roles of R&D personnel have larger regional differences. Hereby, this paper will raise some relevant policy suggestions from strengthening independent innovation, paying attention to digestion and adaptability improvement of introduced technology, reinforcing intellectual property protection, and taking regional coordinated development into account, etc.
