A Report On The Translation Of A Personal Credit Line Loan Contract

Nowadays, with the deepening economic globalization, countries have become more closely linked in economic, political, legal and many other fields. Among them, laws and legal documents, as carriers of commercial and legal content, are of particular importance to people’s business and social activities. It is especially the case that those who engage in foreign-related activities or execute relevant actions must know and understand relevant laws and related legal documents. Legal translation becomes indispensable for the parties to a contract or an agreement.As part of non-literary translation, the source text of this translation project is a loan contract which falls into the category of prescriptive text, but the target text/translation falls into a perspective text and informative text. The main target readers are American law firms and authorities and the purpose of this translation is to help to prove the applicant’s source of income and capital lawful. This translation project has a strong practical and theoretical significance: as legal translators, we should be good at contract translation. The more we practice, the more professional and competent we will become, consequently, we can provide legal translation services to the institutions, such as foreign-related law firms, foreign law firms, multinationals, large state-owned or private-owned legal departments, government departments, the four giant accounting firms and large banks, etc.In the main parts of this thesis,the author firstly describes the background of the translation task,the linguistic and textual features of the source text,the translation principles,the possible strategies for the translation task,the measures for quality assurance,and other necessary preparatory work.Then the author expounds the whole translation process.In order to guarantee the consistency in the translation process and ensure the quality of the translation task,a bilingual glossary was prepared by picking out the repeated words and phrases in the whole text and by referring to four parallel texts:the International Commercial Loan Agreement,the Contract Law of the People’s Republic of China(《中华人民共�'�国合同法》),the People’s Bank of China Lending General Provisions(《中国人民银行贷款通则》),and the Guarantee Law of the People’s Republic of China(《中华人民共�'�国担保法》).Furthermore,the source text will be translated with the help of SDL Trados 2014 so as to further guarantee the conceptual congruency,stylistic consistency and accuracy of the translation task.Besides,the author will focus on the discussion of some typical problems encountered in the translation process,and their solutions as well as translation strategies by referring to various reference works.Through this project, on the one hand, the author hopes to improve his contract translation skills, and to learn more about the textual features of contracts, related translation theories and strategies of legal translation. On the other hand, some effective contract strategies are recommended in order to contribute to a better understanding of foreign investment immigration programs, an enrichment of legal translation teaching and the compilation of parallel corpus.
