Translation between Chinese and English takes a main part in most of the books published and researches done about the business contract translation in China in the past. Very few researches have been done on the business contract translation between Chinese and Japanese. Research achievement of business contract translation between Chinese and English can not be widely used in that between Chinese and Japanese because of the great differences in custom and manner of expression between English and Japanese. Business contract is an important means of commercial exchange. As long as the author considers that Skopostheory is fit for business contract translation research, this paper intends to make a thorough inquiry on business contract translation from the perspective of Skopostheory.After formalism, German functionalism, which integrated many other subjects, becomes an influential theory of translation in late 1970s. German functionalism, emphasizing socio-cultural factors and absorbing communication theory, action theory and text linguistics, forms it’s distinctive theory school. The theory considers that translation is not the process that two languages translated to each other, but a specific action of human beings. As well as other human actions, translation has it’s specific purpose which must be defined before translating.Regarding the translation of business contracts to be an action with purpose, this paper is to be instructed under Skopstheory. In the first part, this paper introduces the conception of Skopstheory and the three principles used in business contract translation. The second part focuses on the characteristics of Japanese business contracts. Then, solutions are to be put forward by analyzing the mistranslation we meet in the process of translating the Chinese business contracts into Japanese through instances. Finally, this paper discusses the strategy of translation.
