This translation project is divided into two parts:Part one presents the original text and the translation of the selected part. Part two is the Critical Commentary. The original text translated in this project is excerpted from the book Jury Selection:The Law, Art and Science of Selecting a Jury. With the progress of the US-China exchanges and cooperation, Chinese people have known more about the American legal system. Many Chinese people, for instance, know there is a system called jury system in American law, but they know little about how this system is implemented in practice. And the translated text introduces the process of selecting a jury from the procedure of voir dire to challenge of jurors when jurors are allowed to question witnesses. In the meantime, the People’s Assessor System in China needs to be improved. Even though these two systems belong to different legal system, they can still learn from each other in some points, such as how to choose jurors or assessors. It is thus of some practical and academic significance to translate the excerpted part into Chinese. The Critical Commentary is composed of three parts. The first part is the introduction part, including the information of the book and authors, the significance of the project and literature review. The second part is the main body of this critical commentary. In this part, various translation strategies are analyzed with typical examples under the guidance of Nida’s functional equivalence theory. The translation is analyzed from two aspects:the lexical and the syntactic levels. The last part is the conclusion part which summarizes the previous discussion and some reflections obtained from this translation project.
