| Since the merger of low-rent housing and public rental housing in 2014,China has basically built a housing security system with public rental housing as the main body,which has played a major role in protecting the right to adequate housing of low-and middle-income families,especially the "sandwich" group.However,due to the absence of a sound legal guarantee system,the welfare solidification thought of"fraudulent rents and rents" and "only inaccessible" is very serious in practice,which takes up a large amount of public rental housing resources,resulting in the inability of public housing resources to flow effectively.Residents who should enjoy the benefits of renting housing cannot get the corresponding guarantees,which infringes on their basic residency rights,easily leading to social unrest.Therefore,the voice that "You should withdraw and withdraw timely when it is time" is an inevitable trend and is getting higher and higher.This article discusses how to guarantee "You should withdraw and withdraw timely when it is time".On the basis of studying the existing regulations with regard to the exit mechanism of public rental housing in China,the paper proposes to formulate a scientific and efficient public rental housing exit legal system.Firstly,this paper briefly describes the background and research significance of the legal system of public rental housing exit in China and sorts out the existing research on the legal system of public rental housing withdrawal in China.It is concluded that the research on the legal system of public rental housing exit in China is gradually deepening and from the improvement of the hardware to raising people’s awareness,but it is few in number and not non-professional.Secondly,this paper analyses the connotation of the legal system of public rental housing withdrawal and the necessity and function of setting up the system starting from the theoretical basis of the legal system of public rental housing withdrawal.Next,the main problems are summarized,such as imperfect of laws and regulations,imperfect of withdrawal standards,imperfect of reward and punishment mechanism,imperfect of supervision and management mechanism and lack of security mechanism after withdrawal on the basis of the existing provisions on the of public rental housing withdrawal in China,and the reasons are analyzed.Then,the thesis learns from the successful experiences of major market economies and regions such as Chinese Hong Kong,Singapore,the United Kingdom,and the United States.Based on Chinese mainland’s national conditions,it provides some targeted legal suggestions on the lack,such as the formulation of a detailed exit procedure about the regulation of "refusal to quit",the establishment of a legal litigation department responsible for resolving litigation and settlement matters in the special regulatory agency.Finally,thi’s article summarizes that the authors believes that scholars should study in more depth to propose more practical and practically perfect programs.It is expected that China will introduce the Housing Security Law as soon as possible and provide for the public rental housing withdraw from the law system in the form of basic laws. |
