Study On The Principle Theory Of Regional Human Right Protection Mechanism-

Human right protection has been a hot issue for quite a few centuries. Human rightprotection has to rely on domestic protection system in most cases,but regional humanright protection has also been put into practice for a long time along with the tendencyof globalization.Europe has found out an effective human right protection mechanismwith judicial and political means since the postwar years in1950s.The European modehas made great achievement and provided plenty of experience for Africa and America.The regional human right protection is based on the political and economiccooperation and it is always taken as a political and international law issue.It is quitenecessary to clarify that regional human right protection also has constitutionalimpacts.The regional human right system will definitely affect the domestic legislationespecially the amendment and practice of constitution.On the other hand,the regionalhuman right system can also help us do research on the constitutional democracy designof intergovernmental organization.The history of regional human right mechanism accumulated different kinds ofexperience which has been the main resource of the study on human right protectionmechanism.Asia is the only region that has not established regional human rightprotection system.We need to find out the possibility of Asia human right protectionmechanism with the study of the principle theory of regional human right protectionmechanism.This thesis consists of four chapters:the first chapter gives brief introduction to thetheory of human right and regional human right protection.The second part will coverthe regional human right protection mechanism in Europe,Africa and America as wellas the conclusion of their experience.The third chapter makes deep analysis and studyon the principle theory of regional human right protection mechanism.The last partmainly discusses the possibility of the establishment of Asian human right protectionmechanism.
