Study On Juvenile Suspects’ Rights Protection Mechanism

Being immature in both physiological and psychological prospects, the under-aged is a special group, there is no doubt that they can not foreseen the consequences of breach of laws by themselves, not to mention that they usually not be able to tell right from wrong, or control their behaviors sensibly. In the recent years, the severity that crime is becoming younger-aged has been floating up, as people now have better understanding of laws, they do not necessarily think the younger criminals are deserving the penalties, instead they would at some point pity the youngsters who themselves are the victims of the society.One of the values about juvenile justice of UN is to protect the under-aged criminals-Many countries in the world has built up consummate judicial system to provide better protection to youngsters. However, our current judicial system is not adequate to shield the increasing number of under-aged criminals. Actually, quite a lot of the under-aged criminals have been going through the procedure same as the adult offenders, and been labeled as criminals since then. It neither in line with the requirement of international appeal, nor do the system provide a good environment for us to educate and save the juvenile delinquents.Though we initiated the research for the rights of juvenile delinquents relatively late, however it develops fast and achieved notable success. However, the weaknesses in theoretical basis result in more uncertainties in the development. In recent years, our judicial system have put more weight on the protection of under-aged group, and the academic research in this field is also getting more systematic and in depth. It is of significant meaning for us to make efforts on the protect system of younger criminals, not only for construction of judicial system, but also for the safeguard of human rights.This article mainly discusses on the leakages of present judicial system for juvenile delinquents, and elaborates on the measures we can take to make improvements on same. The topics including the developments of judicial system, also covers the experience gained by other countries. The author hope this article can be useful to improve the present system of protecting rights of under-aged criminals.
