Research On Trade Association Of Anti-dumping Investigations Strategy

Dumping and anti-dumping in the stage of world trade that is one of the most basic phenomenon oftenoccurs. Usually dumping is considered to be unfair trade practices, also banned by the world tradeorganization. Anti-dumping recognized by the world trade organization is a legal means to protect domesticindustries, so more and more countries favor it. But because trade protectionism still exists, theanti-dumping often is abused by some countries, and gradually becomes the main form of internationaltrade barriers. At present, China has become the most serious damage countries in the world’s anti-dumping,facing serious anti-dumping situation., China has been17years in a row as the top target of anti-dumpingin the world since1995.On the stage of international anti-dumping, the trade association has been brought to the attention ofthe developed countries as "the applicant" and "stakeholders" in anti-dumping. In mature market economycountry,it plays an irreplaceable role. From the anti-dumping filed to the anti-dumping investigation ofnegotiations, there is an trade association. And Chinese trade association under the existing system can notadapt to the needs of the development of marketization and internationalization,which is becaming a "shortboard" in the field of anti-dumping in our country. The reason is that the trade association has strongofficial color. In order to seek the development of Chinese trade association path,we are based on thecomparison and draw lessons from the successful experience of the foreign trade association,and then weput forward the direction of the development of China’s trade associations and the way to improve theanti-dumping measures. In order to perfect the system of its own,and to make trade association play itsirreplaceable role and make its due contribution,we must crack the anti-dumping problem that China facesthrough trade association.for our country market economy reform and the development of export-orientedeconomy.Besides preface and epilogue, this article is divided into four parts:The first part introduces the theoretical foundation of the trade association to participate in theanti-dumping and the basis, this part first introduces the concept of trade association,dumping and anti-dumping and controversy. Then respectively from the Angle of law and economics, it analyses thenecessity and feasibility of the trade association to participate in the anti-dumping.The second part analyzes the cause of the current situation of the development of China’s tradeassociation and its particularity from the actual situation of our country.This part mainly introduces thepresent situation of the trade association in developed countries.And then it analyzes trade association’sown advantage, especially in the irreplaceable role in the field of anti-dumping. By contrast this part findsthe problem of our country’s trade association, the necessity and urgency of the current situation of thetrade association in ChinaThe third part is the core content of this article. The anti-dumping is one of the many functions of tradeassociations. So we must find the root of the problem to reform the trade association of the existing systemwhich is the foundation of healthy trade association and is also the foundations of the functioning ofanti-dumping and trade association.The fourth part is how to perfect the countermeasures our country trade association deals withanti-dumping investigation.
