The Study Of The Problem Of Community Correction In Yongtai County, Fujian Province

Community correction, as a kind of penalty model, is significantly different from imprisonment. It started to be very prevailing in western countries in the beginning of the20th century. Method of community-based criminal correction gets affirmation of the U. N. Commission on Crime Prevention and Criminal Justice), and it is implemented all over the world. Human rights protection concepts filter into people’s minds in the process of promoting community correctional system. With the development of society, as a product of the reflection and reform of the penal system, the establishment and perfection of community correction system is of great significance to promote the construction of a harmonious society.To explore the community correction, is helpful to guide the practice of the pilot work, regulate and protect the operation of judicial social work. The current procedure and conditions of the community correction needs to be constantly explored, so that judicial social work will be more targeted to carry out. And it will guide social workers to explore a more suitable way of community correction and improve the technical requirements and improve corrective effect.On the basis of studying the domestic and foreign community correction, this dissertation, through adopting the theory of community correction, the method of questionnaire investigation, interview and empirical analysis, explored the existing problems in the implementation of community correction system in Yongtai County in Fujian Province.First of all, in this paper, the related research theory of the emergence, development and inner link between the community correction system at home and abroad are discussed and explored. Then, it also deeply analyzes the fruit of the implementation of community correction system and its related issues in Yongtai County, and important problems of community correction are summarized. For example, the applicable scope of the system is too small, and the subject of enforcement is fuzzy; the legislation is too single; the quality of correcting team is too low, the rural correction work is difficult to implement. A variety of problems, limits the smooth implementation of community correction. In addition, it analyzes various aspects of the in-depth implementation of community correction. This study choose Yongtai county, Fujian province as the investigation object. It gives a field survey for the correction situation of offenders in the community and also interviewed community correction administrators. The "Glorious Sunset" community correction in Yongtai County and their one-to-one-support of the volunteers, is effectively guiding the community correction workers return to society. It is of great significance to maintain social stability and obtain the good social effect. It is worth promoting.Finally, according to the survey results, combined with the actual situation of Yongtai County, from the law, system, means, methods, this dissertation puts forward my suggestions to improve the system of community correction:Perfect the legislation in the community correctional system emphasize the respect for human rights, and Ensure the correct object’s human rights; Determine the setting of executive institution of community correction, explore the executive office of community correction system, Reform and perfect the existing system of community correction; Carry out the classified management in case correct working mode, and its diversified management and supervision; Attach great importance to the social work intervention and strengthen the construction of the volunteer team.
