Research On The Legislation Of Government Information Disclosure

With the development of economy and the deepening of reform andopen up, China’s construction of democracy and legal system has beenmade great achievements. People’s democracy consciousness and legalawareness are increasing ceaselessly as well as the demand of thegovernment information publicity, the State Council took great efforts onthe government information system exploration.“Republic of ChinaGovernment Information Disclosure Ordinance” was promulgated by theState Council on April5th,2007and was formally implemented in2008.The “Regulations” is the China’s first regulation on the governmentinformation public legislation, its promulgation marks that significantprogress of China’s open government information system construction,plays an important role in the democracy and legal system building. Thishas promoted the transformation of China government function andguaranteed citizens’ political rights. This doesn’t mean that the Chinagovernment information system is perfect, it’s the beginning of China’sgovernment information disclosure legal process, we should notice thesituation of the government information disclosure in China that it will bea long way to study and solve the problems. This paper has analysis andcompare domestic and foreign government information open system, findout reasons of the publicity of government information in China, attemptsto solve these problems from the legislative point of view.This paper is divided into five parts. The first part is the purpose ofthe selected topic and the significance of topic selection, and the researchmethods of this article. The second part is about the governmentinformation publicity system theoretical basis for comprehensive analysis.The third part from the tow aspects of development course and the legalmechanism to analyze China’s current government information twoaspects of law philosophy and economics analysis of the theoretical basisof government basis of government information disclosure. The fourthpart discusses the legal basis of the government information publicity system, points out the present stage in our country governmentinformation disclosure work at specific issues. Put forward the necessityand feasibility of legislation of government information publicity. Thisfourth part summarizes the development of the foreign governmentinformation publicity, affirmed the experience to the legislation of ourcountry government information publicity. The fifth part puts forwardlegislative suggestions of perfecting our country government informationdisclosure system.
