The Approach To The Peoblems And Solutions Of The Community Correction In Yanji.Jilin

With the development of the society, the idea of generous penalty has become the inevitable trend of world’scriminal punishment. On such social background, the system of punishment of many nations on one hand insist prison sentences, on the other hand they began to adpot nonprison sentences. As a nonprison sentence, community correction is carrying weights by many nations. China has been a severe penalty doctrine of state for a long time, community correction is definatly a great impact on the traditional criminal system. Without doubt, the community correction is going to be one of the important contents of judicial reform. The regular attemption to adopt community correction had been launched by central authority. The Supreme People’s court, the Supreme People’s Procuratorate, the Ministry of public security and the Ministry of Justice jointly released the<Notice on the pilot work of community correction> on July2003. Since then, the community correction carried on nationwidely. Now this system has received a great achievement, but as a new kinds of punishment, it still has many problems and flaws in practice. So we have to interpreted and enrich it theoretically,improve and modify it in practice.This paper firstly introduces the community correction theoretially, then discover the problems existed in the syetem of China’s current community correction through the investigation and analysis on several community correction centers in Yanji city. At last, combine these problems with the present practical situation of our country, come up with solutions to these problems, offer some feasible advices.
