As a newly-emerging industry which started lately, tourism industry is now developing very quicklyand is obtaining better and better economic profits in its unique vitality and developing potentialconsequently with the rapidly developing and running national economy. Shopping is one of theexperiencing links of tourism industry, which may influence the travelers’ objective comments on the tripand even on the image of the travel destination. Henan province is enriched with lots of tourism resourcesand hence has a variety of tourism merchandise. However, the consuming on the tourism merchandise inthis province has always been in a lower level which earns far less than the revenues made by scenic spotstickets, food and beverage, accommodation, etc. Furthermore, quite a few tourists are not satisfied with theshopping experiences. There are many reasons of this phenomenon, one of which is the poor shoppingcircumstance, a main cause of the tourists’ unsatisfaction.The implementation of Tourism Laws on1st February,2013, which sets the clear rules that the travelagency is not allowed to make the unsuitable revenues by arranging shopping, adding items at tourists’ ownexpenses or appoint any specific shopping places during the trip, has brought hope and guarantee to thedevelopment of Chinese tourism industry and caused a great social reaction. Since then, the travel agencieshave regulated their products such as largely eliminating the shopping routes and places. The developmentof tourism shopping in such areas as Henan Province in which the percentage of shopping is smaller ismuch worse under this condition. Hence, it must be well-realized that how to improve the tourists’shopping consuming and promote the tourism revenues without affecting the tourists’ trip based on theregulations of Tourism Law and specification for travel.The related literature review reveals that there are few researches on tourism shopping circumstanceand such researches are generally concerned about the compositions of tourism shopping circumstance.Based on the previous researches, this dissertation takes it as the object of this research that the legalestablishment and management of tourism shopping circumstance in the developing tourism industry, aimsto investigate and analyze the problems regarding the tourism shopping circumstance in Henan provinceand furthermore proposes some strategies to solve these problems. The first part of the dissertation analyzesthe impacts that the establishment of tourism law system has on the tourism industry both abroad and athome by combining the literature review on the advanced experiences with investigating the unique tourism shopping circumstances in Henan province. The second part studies the functions and developmentof Tourism Law and tries to explain its functions in the field of tourism industry from a legal point of view,which inspires an empirical analysis on the situation in Henan province so as to enhance the improvementand development of the tourism shopping circumstances in that province under the supervision of the law.The last part is a summary and proposes the corresponding problem-solving strategies such as a better andinfluential tourism shopping circumstance which is adjusted to meet the tourists’ shopping needs in Henanprovince and even in the whole country, in consequence of increasing the local shopping consumingrevenues and tourism revenues. It is expected that this research shall provide the reference frame forperfecting the related local laws and regulations regarding tourism shopping and provide guarantee forconstituting the perfect tourism shopping circumstance as well as stable and sustainable development.
