The Analysis Of The Present Situation、Reason And Countermeasures Of Rural Left Behind Children Crime

In recent years, with the industrial restructuring, rapid development in society and economy, accelerating process of urbanization, increasing in the migration of rural labors into cities, it shows an increasing trend of left-behind children in rural areas. Childhood is a critical period of the formation and development of one’s emotion, morality and character, at which time parents’care and lead are needed. But long separation from parents and lack of necessary care lead to negative emotions, lose and inferiority included. Meanwhile, the weakness of discriminability between good and bad information cause left-behind children to hurt others or to be injured frequently. The paper mainly analyzes how to enhance legal education of those left-behind children from the current situation, crime characteristics, criminal causes and other aspects. Not only a fundamental requirement, it is a groundwork and important measure to protect the legitimate rights and interests of minors and to prevent minor crimes. Putting the measures presented in the paper applied to control of left-behind children crimes, it hopes that legal consciousness of left-behind children can be strengthened and behavior can be standardized, which aims to prevent and reduce the crime of left-behind children.The paper is divided into four parts. On the basis of the concept of left-behind children in rural and current situation, it points the specificity of these crimes and analyzes the causes. In allusion to the causes, the author put forward preventive measures from the view of family, school and society. Under the supervision from the three aspects, it aims to make those left-behind children grow healthily, feeling love and warm.The first part points out the historical background and practical reasons of left-behind-children phenomenon from different points of view and levels. Meanwhile, by illustrating data tables, it summarizes the current situation and social influence of left-behind children.The second part focuses on the situation on crimes of left-behind children. It analyzes from the view of perpetrators and victim at the same time. By analyzing the actuality, it presents that in recent years, the quantity of left-behind-children crimes is on the rise; and crimes are led by the type of property. Due to the specificity of subject of crime, it shows these characteristics:intentionality, violence, greediness, burstiness, blindness and randomness.The third part analyzes the negative effects on left-behind-children crimes from different social subjectives, which are family, school, society and self. And also it points out the reasons. Owing to the deficiency of function in left-behind-children family, to some extent, positive education at school will cover the shortage. Once the school education is ineffective, the possibility of children to crime is more. Due to the weakness of discriminability, in the complicated society, left-behind children are easy to self-indulgence, and to the road of crime involuntarily.The fourth part is mainly that on the basis of analyzing the causes of left-behind-children crime in rural, it put forward effective measures to control and prevent these children’s crimes from the view of family, school, society and self. The measures will help them out of the confusion of life and restart their wonderful journey.
