In recent years, China is experiencing a rapid economic growth, with catering industry making undeniable contributions. This is the outcome of market economy effect. However, the subsequent and frequent food safety incidents reveal the fact that market failure is apt to be the norm. Food vendors, as an important part of catering industry, locating at the terminal link of food supply chain, has not been immune to its influences. One way to deal with "market failures" problem is to resort to the "invisible hand",namely, the governmental supervision, to make up for the deficiencies in market mechanism. However, as the supervision practice in recent years indicates, the result of government supervision is not satisfactory. The problem of "market failure" is still plaguing food safety in catering industry. Thus, it is necessary to have a rethink about the current situation of the supervision of street food safety.Food vendors could be initiated with very few staff and cost. With further intensified economic transition, an increasing number of migrant workers, unemployed and self-employed staff, are or will be on the way to it. Proprietors are profit-seeking, which has brought severe challenges for the field of food safety supervision. For instance, the proprietors run their business without performing food safety regulation; Meanwhile, proprietors are unable to purchase facilities and equipment to ensure food safety due to lack of money and unawareness; Additionally, proprietors are short of knowledge and competence in executing food safety control. Confronted with such challenges, it can be said that the legal system of food vendors safety supervision is extremely imperfect, especially in the following aspects:irration-ality in function design and resource allocation in supervision organization; inexecution of accountability system for governmental supervisors; singularity and passiveness in the approach of accountability system; low effectiveness in the method of bearing legal responsibility. Therefore, confronted with such a high-risk area in terms of food safety, we need to change the ideas of supervision with the combination of the ongoing food safety supervision reforms. Besides, increasing government support should be given to the area of food supervision. In addition, proper guidance should be provided for foodt vendors to operate centralized business. Finally, overall social resources need to be mobilized, such as performing the third-party inspection, amending or formulating laws and regulations without delay. An joint governance should be built with cooperation among enterprises, government and society in order to establish a sound supervision system for street food service.
