The Issues And Countermeasures Of Administrative Law Enforcement About The South China Sea

In 2013, the State Council to solve marine institutions repetition and enforcement difficult problem, restructuring the State Oceanic Administration, integrated management of marine affairs, coordinate the relations between China and the neighboring sea area.This major initiatives are not only conducive to strengthening the capability of national comprehensive management of marine affairs, meet the marine management internationalization, modern development needs, at the same time, how the government will in fishery management reasonable administrative law enforcement issues, triggered on a warm circle.This thesis mainly consists of five parts: access to a large number of domestic and foreign based on accumulation of fishery law enforcement related data, combined with the development planning of the current domestic maritime law enforcement agencies reform, completed the first part of this paper, including the introduction and the second chapter, this paper mainly introduces the research overview at home and abroad were reviewed, and the research mentality and the method. Research situation about the fishery administrative law enforcement at home and abroad is discussed, and introduced the fishery administrative law enforcement related theory; the second part is the third chapter, introduces the general situation of the development of China’s fisheries administration and fishing law enforcement agencies, special circumstances with the geography, the South China Sea to explore the South China Sea fishery law enforcement of the current management system, in-depth analysis of the existing problems and the South China Sea fishery law enforcement. The third part is the fourth chapter, on the basis of understanding and analysis of foreign advanced fishery management and fishery law enforcement, put forward the concrete measures of learning foreign fishery administration. The fourth part is the fifth chapter, mainly analyzed our country local marine fishery administrative law enforcement mode for the local Marine fishery and fishery construction situation, summarizes the fishery management mechanism and law enforcement system’s achievements and experience. The last part is the sixth chapter,based on related theories from the domestic and foreign, combined with the foreign advanced marine fishery administrative practice, the fishery administrative law enforcement reform of our country’s policy recommendations on marine fishery law enforcement under the new system of administration according to law and how to better perform their duties, fishery law enforcement, protection of fisherman’s interests,safeguarding national oceanic and fishery rights and interests and guarantee the implementation of National Oceanic and fishery laws and regulations, to provide a strong backing for the administrative development and protection of fishery resources, to promote the comprehensive, coordinated and sustainable development of fishery resources in South China sea.According to state council on promoting healthy development of the fishery in 2014,the innovation of this article, combined with the south China sea fishery agency integrated planning and the south China sea situation, in view of the specific problems of the south China sea fishery law enforcement Suggestions put forward the corresponding development, emphasis on local rules and regulations construction, the fishery law enforcement team construction and fishermen third party organization construction,improving the fishery law enforcement power and enforcement ability of the south China sea.
