A Study On Legal Issues Of Government Purchase Community Aged-care Services

With the advent of population aging society, how to solve the problem of pension better, make old people happy, and not to leave their community of life, is a major challenge facing the government. Because of family structure change, the function of family endowment weakening and the lack of institution endowment funds difficult, the development of government purchase of community endowment service will become the effective way to solve the problem of pension. Several typical countries development status and characteristics of the related system to our country the government to buy inspire the construction of community endowment service system is studied in this paper. Through comparing the status quo of domestic and foreign relevant system, put forward the problems in our country at present the government purchase of community endowment service, and seek solutions.The first part is theoretical analysis for the government purchase community aged-care services, introduces the related concepts of the government purchase community age d-careservices. At present the academic circles about the concept of community endowm ent is not clear, they mainly distinguish pension and social pension and the community h ome endowment difference. It is theoretical basis of government purchase of communit y endowment service, at the same time, analyses the feasibility of this system to carry o ut and implement effect. The second part is introduces the birth and development of relat ed systems from the UK, Japan and the United States. Focuses on analyzing the characte ristics of the foreign related system in order to the improvement of the system of govern ment purchase of community endowment service have enlightenment. The third part, thi s paper introduces the status of community aged-care service at present, China’s governm ent purchase, the general pattern is analyzed, and on China’s Nanjing, Ningbo, Dalian an d Shanghai pilot in the concrete practice, resulting in line with the general pattern but als o introduces the practice pattern with local characteristics in order to provide for the pro motion of government purchase of community endowment service system rest. At last, b y comparing system at home and abroad and analyses the existing problems in China ar e put forward.The fourth part, to the government to buy the community endowment servi ce system of the existing problems are also proposed. Should perfect legislation, establis hing clear responsibility, unity government purchase mode, establish more strict and com prehensive supervision system, and the funds safeguard can continue to implement the go vernment purchase of community endowment service system in China.
