Research On The Prevention Mechanism Of Duty Crime Of Village Committee Members

With the comprehensive social reform and under socialist economic system of China, rural economy has been developed with unprecedented speed. Meanwhile, new rural construction enables the cadres at the grassroots level to gain access to the control of more resources and opportunities. Though the village officials are on minor positions, their corruption will seriously damage the interests of the state, the collective and the people as a whole, which is a microcosm of "minor officials causing big corruption". In recent years, duty crimes of village committee members, ranging from using public funds for recreational activities to more serious duty crimes, have increased significantly, causing severe negative influences to the basic level construction and harmony and stability of our country. Prevention of duty crimes at village committee member level is an important part of the duty crime prevention work of our country. This paper attempts to investigate and analyze the duty crime cases of village committee members prosecuted by People’s Procuratorate of Xixia County during 2009 to 2013. Based on the connotation, the present situation, causes, harms of the duty crime of village committee members, combined with actual cases, the causes of crimes are analyzed comprehensively from the perspectives of the subject of the crime itself, the external power system, law and supervision mechanism. Survey shows the duty crimes of village committee members are of large amount, involve huge sums of money and a wide range of fields, and with complex criminal context and serious consequence, causing severe damage to the legitimate rights and interests of the state, the collective and farmers. The punishment effect of duty crime of village committee members and effective prevention of the corruption occurring among the general public will significantly influence the stability of rural society in China. Improper handling of this issue even may produce large negative influence on the ruling foundation of our party at the grass-roots level. Thus, the prevention work of the duty crime of village committee members is of special importance. According to current law in our country, combined with actual situation, the effective governance of duty crime of village committee members relies on the following two aspects. First, the relevant legal system must be improved continually. Second, a complete set of soft governance mechanism must be formulated to prevent the duty crime of the village committee members.
