Labor Contract Law of the People’s Republic of China Order of the President wasinitiated in2008,for the first time admitted that legalization of labor dispatch.It useone section, for eleven terms to illustrate our country labor dispatch agencies accesscondition, the applicable scope of labor dispatching, labor dispatching employeecompensation package, etc. It played a large specification for labor dispatch industry,although labor dispatch at the development stage in our country. But with the rapiddevelopment of labor dispatching market in our country, labor dispatching industry hasexposed many problems, Labor dispatching abuse, auxiliary job definition is not clear,to get different pay, Labor dispatching employee rights without guarantee, etc. So in2013the labor contract law was amended in our country,the key is to furtherstandardize the labor dispatching.At the end of the same year issued the interimprovisions on labor dispatch,it has been clear about the proportion of labordispatching labor, labor dispatching agreement concluded and the performance and soon,it play a huge role to the specification and development of labor dispatchingindustry. But as a result of labor dispatch agencies, employers, labor dispatch staff’scomplex relationship, some problems still can not get practical solution, attributed themain reason is that local governments in China of labor dispatching industry regulationis not enough..This article in the new "labor contract law" after the implementation of as thebackground, study the problem of labor dispatch. First, clear the main theoretical basisfor the development of labor dispatching, core competence theory, transaction costtheory, principal-agent theory and the theory of the division of labor. Case analysis asthe main research methods, from regional characteristics, the degree of economicdevelopment, labor dispatching problem of point of view, selection of China’s threemore representative of the Jiamusi, Luoyang city and Shenzhen city, this paperdiscusses the respective city the main problems existing in the development of labordispatching. A comprehensive system of local government in our country is analyzedin labor dispatching industry regulatory difficulties. Finally, from the labor dispatchagencies, employers and labor dispatch staff to summarize the regulations of localgovernment in China. Labor dispatch as a new form of employment, effectively reduce the labor unitcost of human resources, the formation of the employment market diversificationdevelopment. Because of this, more should pay attention to labor dispatching industryproblems, strengthen the supervision of local government in our country,fundamentally solve the problem, realize stable, healthy development of our countrylabor dispatching, and promote the harmonious development of economy in ourcountry.
