| Taking drugs, complicated as the problem is, involves both subjective and objective factors as addiction and misconception. The social environment, meanwhile, has an influence on the public knowledge of drugs.Taking drugs is consequently a special phenomenon, which calls for the whole society to take the responsibility and help addicts receive treatment. The lopsided view in the past, exposing the addicts to punishment or restriction of personal freedom, ignores the fact that these addicts are patients and victims themselves. Anti-Drug Law, enforced in2008, reconstructs the system of rehabilitation. The law defines a series of measures in rehabilitation, including volunteer drug rehabilitation, community drug rehabilitation, forced quarantine rehabilitation and community recovery. Community drug rehabilitation, advanced as a new concept, is fixed as a point of law and will be the most general and important mode in China. It witnesses a strategic transform from a rehabilitation mode of enforcement and punishment to a social mode of community help. Still dwelling in a familiar community, addicts receive rehabilitation treatment with the help from their families, friends and the society. It can prevent social alienation and negative mentality caused by a long-term isolation. Besides, the new mode represents the scientific and human-based features by reducing negative interactive behavior and encouraging a social reintegration.Lack of legal support and standardized execution, in the trial run of community rehabilitation, causes a good number of problems in the comprehension and execution of the Anti-Drug Law. Anti-Drug Regulations in2011, based on the implementation experience of the Law, defines some aspects as the identification matter, anti-drug security system, drug control measures, legal obligation and legal validity of the regulations. The definition solves some problems in the Anti-Drug Law and improves the execution of community rehabilitation, which promotes the drug control in the communities. But there are some weak points. The relevant laws and regulations haven’t received a wide acceptance from the local people. The public still holds some faulty ideas of the community rehabilitation system. And more active participation is needed. A vague division of obligation and rights obstructs an effective execution of the executable units and their authorities. At present, the community development can’t satisfy the functional needs. In the operation of the community rehabilitation, such problems as unspecific anti-drug measures, vague regulations and legal loopholes come up. The abuse of addicts’ rights still prevails in the reality. The funding can’t be fully guaranteed due to regional differences and limited funding sources. Compared with the past, the community rehabilitation system makes great progress and the operation is gradually standardized. But the problems mentioned above inevitably influences the effect of drug addiction treatment. Moreover, they are related to the final outcome of the nation’s battle against drugs.Still at the initial stage, the community rehabilitation faces challenges and hails to development. Based on the rule of law, the idea of community rehabilitation should be deepened and promoted. The publicity of narcotics control will win more supports from the local. The implementation capacity will be strengthened. A clear definition of responsibility and rights, together with detailed regulations and supporting measures, will improve the operation of community rehabilitation. A better legal system and operation mode will standardize the operational process, perfect the mechanism and meet reasonable requests from the addicts. The funding supported by various channels will assure an effective operation in the community. The battle against drugs is hard and lasting. It aims to establish a more scientific and standardize community rehabilitation system on the basis of both advanced experience from foreign countries and the real situation in China. |
