| Price administrative legal system is a generic term of law-complex. It controls the behaviors of maket entities or manage their relationgships in price area."Price Law",assorted with many othe rules made by administrations and its departments,local governments,constitute the whole system. For the past ten years or more, this legal system has played an active role in chinese maket, mostly positive,such as standardizing the market price behavior, macro-economy control,and guaranteeing the healthy development of economy. However,with the globalization of market economy,,new problems have appeared.The foreign enterprises hold together to implement price monopoly in Chinese maket while Chinese enterprises overseas had to face anti-dumping investigations one by one.In domestic market, some unusual pricings caused many phenomenons to occur,like "Garlic you hard","Bean you play",and the price fighting between traditional commerce and e-commerce platform is escalating. All above proposes us that there may be many shortcomings and imperfections in Chinese price administrative legal system,but we do not have enough researches about it by now except some single investigations or opinions. This article is trying to make a research to Chinese price administrative legal system by empirical analysis way.The disharmony between WTO and demestic laws, price law legislation, law enforcement supervision,hearing procedure,maket price monitoring system, administrative system of accountability and some other topics are concerned in the next pages. Compared with the price law in United States, Japan and Hong Kong, the article tries to find more concrete ways to perfect Chinese price administrative law system,such as improving the price legislation, reestablishing the price law enforcement supervision system, optimizing price hearing procedure, perfecting price monitoring system,revising some rules to integrate with WTO obligations, establishing a price administrative accountability system. |
