Legal Analysis On Conflict And Resolution Between Modern Women’s Dual Role In Gender Perspective

The concept of equality between men and women are formed gradually fromequality theory and the concept of women. When the concept of equality betweenmen and women were developed into the theory of equality between men and women,women have basis theory to fight for rights. Feminist movement for women won awide range of rights, and social gender theory develops with the rise of women’srights.It caused the disintegration of the traditional model of labor socialdivision,which was determined by the sex.In order to exercise the social rights andrealize self-value,a growing number of women went to work. At the same time,women did not give up the family role,women acted as two roles:family role andprofessional role.Due to the influence of many factors such as traditional concept,social dual role expectation and women’s self-expectation, conflict appearedinevitably between family role and professional role. Women fall into plight on howto resolve the conflict.This paper studies the conflict and revolution between modern women’s dual role,analyzes the theoretical basis of women’s dual role, and analyzes the history ofconcept of gender equality and division of labor under the social gender theory. It alsoanalyzes the current situation of the modern women’s dual role conflict, causes of theconflict and puts forward the path of the solution on the basis of theoretical research and practical situation. This paper has three parts:The first part is about the evolution of the concept of gender equality theory.Ancient society has no concept of gender equality.We can only research somethingfrom the view of their female as a glimpse of the concept of equality between menand women.We knew that “misogynistic”was the prevailing view of society. Thoughmodern society had already had the idea of "equality",but the idea of “equality” is stillstay in enlightenment. After the bourgeois revolution the burgeoning feministmovement put the pursuit of gender equality to a climax. At this stage women’s socialstatus were improved and women’s rights were enriched. With the emergence ofpostmodernism in the field of philosophy, the connotation of equality between menand women tends to postmodernism, oppose "homogeneous equal", and advocate theequality of”heterogeneity”.The second part is about the ideal female role under gender equality.The ideal offemale role is multiplicity,femininity and giving full play to play the dual role.Buthindered by many factors,women fall into plight when they face the conflict betweenfamily role and professional role.It brought negative influence to women. Thetheoretical misunderstandings should be corrected in the theory of gender equality.The third part is about the resolution of female role conflict in gender perspective.Social gender theory focuses on the enormous effect on gender role shaping, refutesthe tradition of social division of labor pattern, which is decided by sex.It turns theposition of “women”to position of “social gender”.Women should return to rationalityat the same time, establish the consciousness of self and improve the ability to choosetheir own social role.Encouraging men to participate in housework, valuing ofhousework are the main specific measures.
