Research Into Economic Legislation Of Base Area Of Shanxi, Hebei, Shandong And Henan Provinces

The base area of Shanxi, Hebei, Shandong and Henan Provinces existed for eleven years. As the location of commander-in-chief department of Eighth Route Army and the Northern Bureau, the border area government became the center to guerilla fighting. In the meantime, the government has issued nearly one thousand and economic legislation related legal documents, covering all aspects of economic construction. These legal documents are mostly scattered in various literature collections. According to rough statistics, literature works directly relates to the base area economy legislation has more than20, more than30have indirectly involved.In the basis of abundant historical materials, this paper focuses on the economic situation of legislation, in order to summarize the experience of economic legislation.Among current research achievements, there is still a great deal of room for scholars to do research into economic legislation of base areas of Shanxi, Hebei, Shandong and Henan Provinces. Most scholars’researches relate to this topic from the view of general economic legislation or economic history in modern times, which results in lacking of specific research. Thus, deep researches are in great need. Based on a pile of juristic writing classified by predecessors, this thesis adopts historical research method and document conclusion method to explore economic legislation of base areas of Shanxi, Hebei, Shandong and Henan Provinces in a systematical way.This thesis is divided into six chapters. The first chapter is the introduction, according to the study of economic law has been reviewed, the basic situation of the economic legislation is the focus of this paper. The second chapter explains the background. The base area of Shanxi, Hebei, Shandong and Henan Provinces experienced four stages. The economic legislation process follow three principles, mainly for the united front,"economic development, ensuring supply", suit one’s measures to local conditions. The border region government and the Council have legislative right. The third chapter studies the general situation of tax legislation, mainly includes three aspects of fiscal expenditure, fiscal revenue, fiscal management. The fourth chapter studies the agricultural, industrial, commercial and trade regulations. The fifth chapter analyzes the banking legislation and monetary policy, mainly study the financial legislation. Bank of South Hebei is the mainly bank in the region. With the establishment of currency, in order to consolidate and expand the domestic market, the government expelled the enemy counterfeit money and soil miscellaneous notes. The bank established the related articles on loan, the loan system basically established. The sixth chapter is the summary of the economic legislation. Although the base area faced difficult conditions both internal and external, it insisted promulgated and implemented a series of laws and regulations to regulate the legal channels to base economic development. It has its historical inevitability. Although there are many problems in the implementation process, but most of the laws and regulations have been implemented, to protect the base of economic development, and provided valuable experience for the contemporary China legal construction.In this paper, through the study of the economic legislation, summed up a few points. Economic legislation should be based on China’s national conditions, we must clarify the economic development trend, the country should focus on the central task of economic construction. Meanwhile, we must uphold the Party’s leadership, seek truth from facts, to promote hard work, thrift spirit, and constantly push forward the process of building the rule of law.
