The Governance Of Environmental Group Events Under The Model Of Responsive Administration

In recent years, group events caused by major projects related to environmentalprotection are constantly emerging in our country, local governments dealing withsuch cases habitually use administrative coercion to suppress those. When it is noteffective, governments have to choose to shelve related projects. These not onlyweaken the authority of the executive authorities, waste of resources, but also reflectthe traditional model of mandatory administration facing with difficulties in dealingwith environmental group events. In order to realize the effective management ofenvironmental group events, the administrative organ urge to change theadministration mode from mandatory mode to responsive mode.In this paper, we reveal problems of the existing administrative mode based onthe analysis of the domestic representative part of environmental group eventsthrough the case analysis method, and then put forward a new administrative mode.By comparing the new model with the old, this paper points out the connotation andthe value of the new administrative，the corresponding measures should also betaken.The content of this article is divided into four parts. Firstly problems are foundfrom the existing system model applied to practice. Then introduce the new mode forsolving the problems. Finally this paper discusses the security measures on the newmodel. All above are the clues of this paper.The first part，characteristics of environmental group events are concluded byintroducing the general situation of domestic environmental group events and thecourse of the part of the representative events. On the basis of the analysis of realcases, the plight of traditional model of mandatory administration dealing with suchevents is revealed linking theory with practice. Through the discussion of this part, itrepresents the necessity and the urgency of the establishment of the model ofresponsive administration.The second part, mainly introduced the basic connotation of the model of responsive administration, the justness foundation and basic requirements of it. Thismodel recognizes and respects the subject status of the administrative relative person,the rights they should enjoy. It emphasizes the effective participation of thegovernance of the government and the governments respond to related people, and inthe process of administration realize the dialogue and collaboration between the mainbodies. This model based on the balanced view of the modern administrative law, thedeliberative democracy theory, the right-oriented theory, the principle of due process,and consists of a series of system requirements.The third part, mainly discusses the establishment of the model of responsiveadministration shows great useful value for coping with environmental group events.First of all, under the background of the expansion of administrative power, theintroduction of the model is conducive to provide a new balance for theadministrative power, effectively restrict arbitrary administrative power, and protectthe rights of the public. Second, the use of the model can accumulate moreintellectual resource for government decision-making and reduce the risk ofdecision-making errors as much as possible. Finally, the use of this model providesmore legitimacy support for decision making and promotes the acceptability of thedecision-making.The fourth part, based on previous three parts, comes up with the judicialsafeguard measures for this new administrative model. Firstly, point out the obstaclesthat judicial authority faced in order to supervise executive branch to changeadministrative model and interpose the environmental group events. Then introducesome beneficial attempt judicial authority has carried out. Finally puts forwardsuggestions on the building and improvement of juridical protection.This paper discusses the establishment and use of the new administrative modelmainly revolves around the governance of environmental group events, but those areof enormous referential meanings to other group events management and even to theentire social governance. In the academic world, discussions about the model ofresponsive administration and its application to environmental group events havecarried out. I would try my best to present better targeted discussions on the basis ofthose, especially put forward not only pay attention to the internal construction of this new model, but also emphasis the external restriction that judicial power for itsrealization.
