With the development of the times and the continuous progress of science andtechnology, medical and health services have drawn more and more attention of themasses, thereby requiring a constant improvement of the urban and rural health caresystem. Health care system has a direct influence on people’s livelihood, plays animportant role in the social security system for a long time and provides an importantguarantee for social development. China has nine hundred million farmers, whosemedical care is closely related to the social stability and even the quality of people’s lifeand work. The New Rural Cooperative Medical System refers to a system of mutualhelp and support between medical care and farmers with government’s and guidanceand organization, farmers’voluntary participation and multilateral finance includingindividuals, the collective and the government. Our New Rural Cooperative MedicalSystem fits in with the needs of contemporary politics as a product of the developmentof modern new rural areas. Sound rural cooperative medical system is an important partof both health care system and rural social security system in China. Therefore, thissystem’s establishment and improvement are a guarantee for the ultimate realization ofurban-rural integration; a sound and sustainable medical insurance system is a measurefor the rejuvenation of the nation and is what the people hope for. Therefore, it is thefocus for medical institutions, the nation and the society to carry out the research on thelegal issues of the implementation of the New Rural Cooperative Medical System basedon the actual situation in rural health care to promote the progress of rural medicalhealth care and the cause of farmers’health care, which is of great practical significance.The thesis gave a systematic analysis of the current status of rural health care andthe main problems facing the New Rural Cooperative Medical System by the literatureresearch, interviewing research and qualitative research have been used in the paper toanalyze problems arising out of the system operation, and then proposed thecorresponding solutions in a drive to provide some reference for the establishment andimprovement of the New Rural Cooperative Medical System. During the research, thethesis conducted an in-depth and comprehensive study on legal issues over the NewRural Cooperative Medical System by legal thinking with the use of logical analysis,comparative analysis, historical analysis and other research methods. Starting from theanalysis of the system’s legal nature, the research was based on the determination of its legal nature to improve the legal system of the New Rural Cooperative Medical System.The discussion of the legal issues in the implementation of the New Rural CooperativeMedical System divided the thesis into four parts. The first part is the introductionwhich illustrated the significance of the subject and the research, domestic and overseasresearch status, and related literature review, including the main viewpoints andresearch methods; the second part elaborates on general situation on the New RuralCooperative Medical Care System, including general contents and existing legislativesituation; the third part analyzed the legal issues in the implementation of the NewRural Cooperative Medical System; the fourth part proposed corresponding measures toimprove the system for its better implementation. What makes the paper distinct isshown as follows: Based on analysis and sorting of previous New Rural CooperativeMedical System framework and existing legal issues, the paper focuses on rights andobligations of the three parties involved in the New Rural Cooperative Medical System,namely the government, designated medical institutions and peasants participating inthe New Rural Cooperative Medical System, and emphasizes intensifyingresponsibilities of the above-mentioned three parties. Besides, it clearly defines thelegislative principles, legal responsibilities and legal relief approaches of the New RuralCooperative Medical System, and proposes to establish unified New Rural CooperativeMedical System legal systems. What’s more, it also gives suggestions on perfectingNew Rural Cooperative Medical System operating mechanism from the perspective offunding mechanism improvement, management mechanism improvement andsupervision mechanism improvement.
