A Study On The Path Of Conservation And Regional Cooperation Of The South China Sea Fisheries Resources

The South China Sea is the important fishing grounds of neighboring countries in maintaining national life and improving economy,which is famous for its rich fishery resources for long time. It is not only the important source of food of coastal residents,the important places of employment of fishermen, and the important guarantee for the development of international fisheries trade.However, with the rapid development of economy of neighboring countries, the demand of fishery resources is increasing,long-lasting exploitation activities caused the crisis for the the sustainable development of fishery resources.The serious phenomenon of overfishing and water pollution have been serious.In addition, since the United Nations Convention on the Law of The Sea(UNCLOS) was taken effect, the neighboring countries that originally peacefully engaged in fishing have began fishery disputes, and the intensifying momentum is even to the point of tense.,which becomes the biggest obstacle for the sustainable development of the south China sea fishery resources increasingly and leads fishery resources with the already existing problems is more precarious due to the lack of the necessary management.The over-fishing, the fishery waters pollution and the loss of long-term management constitutes the serious situation of the south China sea fishery resources.This paper combed the serious situation of the south China sea fishery resources.And through the analysis of the necessity and feasibility,it is proposed that the establishing of the regional fishery cooperation organization in the south China sea is the best way to solve the crisis of fishery resources.In the aspect of necessity, with emphasis on migratory, liquidity and communalism of fish resources,on the the legal basis of international fisheries legal policy.such as UNCLOS,the significance of fishery interests on the surrounding countries of the south China sea is analyzed to further determine the necessity of establishing regional fishery cooperation organization.The aspect of feasibility, the neighboring countries have done various fishery cooperation. There are common practices of international fishery cooperation.After the full analysis, the issues relating to the south China sea regional fishery cooperation organization are put forward in the end of this article.First it is discussed that the existing fishery cooperation platform in the south China sea are not the best cooperation form for conservation and management of fishery resources. The core of the point of view in this paper is put forward,which argues the establishment of the Fisheries of the South China Sea Committee,the specialized and regional fishery cooperation management organization covering the surrounding countries Led by China.The article also proposes the management area, set inside, and start running of the South China Sea Fisheries Commission.
