The Research Of Legal System Of China’s Official Property Declaration

China is currently in a period of high incidence of corruption since the founding of New China, is one of the world’s relatively high level of corruption in the country, the spread of corruption has become the main stumbling block of China’s modernization and social stability and the civil servants management."Sunlight is the best preservative", known as the "Sunshine Act",the official property declaration system is recognized worldwide as an effective anti-corruption regime, many countries have already introduced their own legal property declaration system. In the 1980s, China also proposed the establishment of official property declaration system in the form of legislation,and have introduced four provisions,and then in Altay, Cixi, Zhejiang and other places to pilot the property declaration system. But today, China is still not a complete declaration of official property laws. Several of the provisions of the current low level, there is a narrow range of content, subject, procedures and accountability imperfect, and have not been effectively implemented. The foreign legal research started on the property declaration system early, has a more successful experience, not only provides detailed and specific subjects of declaration, to declare their assets, procedures, etc., also it provides include blind trust, financial real-name system and other supporting systems to assist, promote the implementation of property declaration system, these successful experience is worth our reference,in order to establish the system of China’s official property.Therefore,by studying the relevant laws and property declaration to give full consideration to the development of our country to improve its own characteristics as the official property declaration system for purposes, to be adopted by the survey, literature research, comparative analysis of existing methods such as China and the world major study of civil servants from the following aspects of property declare the relevant legal system:First, an overview of official property declaration system of our country as soon as possible to illustrate the necessity of the law,; and second, the current inadequacies of the provisions; third, the cases of foreign legislation can be used for the benefit of our legislative reference, major in US and South Korea; the last is put forward opinions from the system implementation, the establishment and improvement of the system itself and other related systems to expand the discussion to improve the development of China’s civil service property declaration law, and proposed to open new property as a civil servant wage growth mechanism of an important basis in order to reduce the resistance of the declaration. This paper attempts to put forward suggestions for the future management of the civil service as well as legislation, the legislation needs to improve issues related reference.
