Public housing is in order to ensure low and middle-income residents housing for a major people’s livelihood project. Along with the development of urbanization in our country to continue moving forward,low income housing difficult problem increasingly prominent, accordingto incomplete statistics.At present, China’s demand for public housing for low-income families in about 30 million sets, and new demand increasing upward of 5 million sets per year(national urban population about 12 million people a year). So much demand caused a serious shortage of public housing construction fund, only rely on government revenues for investment construction already seem to be too tight, and with the domestic real estate market downturn in 2011, Land repeatedly flopped, local government land transfer income, lead to public housing construction funds is difficult to guarantee. This prompted the governments at all levels of public housing financing model and the study of legal protection.This article studies a serious of problems of financing in public housing areas. This article analyzes the policy and the way to finance in foreign countries. Then solves the problems in law perspective. There is five chapters.Chapter1 studies the background,the meaning and the method. Chapter 2 studies the basic theory of financing in public housing areas,including the meaning of public housing,the development,the meaning of financing and its theoretical basis,the traditional financing ways. Chapter 3 analyzes the problems,such as lack of law 、the traditional way can not meet the financing needs、the negative of social capital 、lack of the financial instruments、lack of the market mechanism、lack of financial regulation. Chapter 4 studies the policy and the way of finance in USA、UK、Singapore and Hong Kong, then analyzes what we can study from other countries and district. Chapter5 suggests that we should establish the law system, establish the housing policy financial institutions, establish the public housing bond financing、mortgage insurance, develop REITs.
