The government’s public service outsourcing is an essential way to the innovation of the public service mechanism and it is also an important part of the reform in administrative systems. The government’s public service outsourcing system which from the Western is a kind of system innovation to provide public service production by using social and market resources of the government. And it reflects the diversified trend mode of public service supply and providing. The public service outsourcing brings opportunities as well as certain risks to the governments. These risks are rooted in the conflicts between that the creed of giving priority to efficiency and the pursuit of maximizing the benefits in the capital market and that the fairness and public welfare of the public service.No matter from the foreign research status of mature view or the present research situation of domestic, study on the risk and the legal regulation of the government’s public service outsourcing has been the emphasis and difficulty of the research in this field. The theme of this study focus on the mining of the legal regulation of risk measures to develop in breadth and depth. This study is divided into the following six parts: the first chapter is the introduction, from the research background and significance to the innovation of this paper and to the research ideas and methods, all of these are the necessary contents. The second chapter is the basic theory of the government’s public service outsourcing, from the analysis of basic principles to clarify the basic concepts, especially the legal regulation measures of the government’s public service outsourcing risk factors, all of these contents laid a research foundation for the latter research. The third chapter explores experience from other countries as well as USA, Germany and Britain. The fourth chapter analyses the situation of legal regulation of China’s governmental public service outsourcing risks. The fifth chapter is the core part of this study, from the general principles of legal regulation to the specific measures, put forward the countermeasures to avoid the legal regulation of the government’s public service outsourcing risk. Finally, the research conclusion gives the brief summary to the whole system, and look forward to the prospect of response to the research subject.
