The Research On Protection Of Migrant Workers’ Legal Rights And Interests In China

Guided by the basic principle of marxism and based on the main line of legal guarantee to the migrant workers’lawful rights and interests, this paper studies the migrant workers to build and improve the harmonious socialist society. After analyzing thoroughly the urgency, necessity and importance of the legal protection of the migrant workers’ rights and interests, the paper analyses the relationship of the legal protection of rights and interests of migrant workers and the harmonious society from the existing legal system in China and migrant workers themselves. From the actual situation of our country, the paper analyses the current situation on the development of legal protection to the migrant workers’ rights based on the theory of marxist. This paper is divided into three parts:The first part is to expound the theory of legal guarantee of rights and interests of migrant workers. This part is the premise and foundation of this paper and the guidance method to analses legal protection of the migrant workers’ rights and interests. Based on the present status of migrant workers’ legal rights and interests protection and their living situation, it analyses the relationship of the legal protection of rights and interests of migrant workers and the harmonious society by marxist theory of the protection of the rights and interests of workers, the marxist theory of human rights and the nomocracy theory in our country.The second part analyses the present situation and the cause of migrant workers’ rights and interests protection in our country mainly in view of our country’s current situation and existing problems of migrant workers’ rights and interests safeguard. It analyses the impact on legal protection of the migrant workers’ rights from five factors:the troditional system of protection of migrant workers’ legal rights and interests in China,social environment, policy environment, legal system and migrant workers themselves.The third part is to provide relevant solutions to migrant workers’ rights and interests of the legal protection. It is the core part of this paper which provides specific solutions from the legislative, administrative enforcement of law and the construction of migrant workers’ rights and interests safeguard system systematically.The paper studies the legal protection of the migrant worker’s rights using the basic principle of Marxism as the scientific guidance, which puts forward several corresponding counter-measures to safeguard their rights and interests so that they could better be involved in the process of our urbanization and modernization construction. In addition, it is conducive to maintain social stability, promotes the process of the socialist harmonious society construction of our country, and ensures that our country could realize well-off all-round society.
