Legal Issues Study On Tourism Macro-control

In recent years,as the country has issued "Opinions of the State Council on Accelerating the Development of Tourism Industry" and "Some opinions of the State Council on promoting the reform and development of the tourism industry"and a series of tourism policy,the development of tourism situation is paid more and more attention by governments at all levels and the broad masses of the people.In the folk, more and more people choose tourism as a way of entertainment;at the national level,the effect of tourism industry on the economy has been paid more and more attention; in the theory circle of our country,more and more experts and scholars began to focus on all kinds of professional tourism problems.After more than thirty years of development,tourism in our country has received outstanding achievements,but there are also some problems need to be solved.While the key to solving these problems lies in the fact that our government should play the role of macro-control, macro-control tourism comprehensively.Therefore,how to better doing tourism macro-control, how to consummate the method of tourism macro-control,to promote the healthy development of China’s tourism industry,is the realistic problem of our country needs to be solved.Therefore,an in-depth study of theoretical and legal problems on tourism macro-control has important theoretical and practical significance.This article is mainly used literature analysis methods,comparative analysis methods and empirical analysis methods,from the definition of the concept of tourism industry, tourism regulation subject, object,content, necessity and legal attribute of the basic problems,through the analysis of the current situation of the development of tourism industry in China,summary and analysis of practical problems in China’s tourism industry,comparing through foreign tourism macro-control experience,to puts forward some corresponding countermeasures to perfect our country macro-control law.The thesis is divided into four parts:The first part is the analysis of the basic problem about tourism macro-control.This part firstly expounds the basic concept of tourism, tourist, tourism industry etc.Secondly has introduced the concept about national tourism regulation control power,and discusses the characteristics, necessity, means and scope of tourism macro-control.And then analysis tourism macro-control in jurisprudence,expounds legal basis and legal attribute of tourism macro-control in the constitution and department laws.The second part is the analysis of realistic problems of tourism macro-control.This part firstly expounds the basic situation and current legislation of China’s tourism industry developed for over thirty years,discusses the practical significance of tourism macro-control,then according to the status of China’s tourism industry and analyzes some existing problems in our country’s tourism macro-control’s means and control system.The third part is the analysis of foreign tourism macro-control legal and policy issues.This part uses the method of comparative study,description and analysis advanced methods and successful experiences in USA,France and Japan’s tourism macro-control,through comparing and summarizing,put forward the enlightenment of foreign tourism legal regulation to our country.The fourth part is the analysis of legal and political countermeasures to improve China’s tourism macro-control.This part summarizing domestic and foreign basic theory and practice experience of tourism macro-control,from four aspects of economic means of regulation, tourism management system and the regulation of legal means and administrative means to put forward the relevant suggestions to improve the legal regulation of China’s tourism industry...
