A Research On The Analysis And Countermeasure Of Corruption Phenomenon In The Collective Land Housing Levy

In urban development and construction process, the city shall be expanded over and over again in the redevelopment, which necessarily involves the connotation of urban functions, adjustment and upgrading, so will the former villages outside the city limits and near the rural suburbs levied, but often these have built houses on the land, lived a lot of villagers and migrants, with land acquisition carried out together on the land as well as the housing levy. Under public ownership of the land, the land is divided into two kinds of state and collective ownership, so the house can be divided into the housing levy levy and collective land housing levy on state-owned land on. Housing levy work related to the future development of the city and the people’s immediate interests, gain widespread concern in the community. In the urbanization process in China accelerate the background around the large-scale urban expansion, are expanding the scope of the city to the countryside, so houses on collective land in scale and scope far beyond the state-owned land. However, due to the lack of similar houses on state-owned land related laws impose collective land and housing levy no laws in practice, the degree of discretion over the large, causing a lot of problems against the interests of the collection of objects, relatively prominent contradictions, even a fierce conflict and confrontation. In addition to legal reasons blank, expropriation corruption also an important source of conflicts and disputes. Housing levy of corruption produced a series of negative effects, not only infringed upon the legitimate rights and interests of national interest and collection of objects, it also undermines the image of the party and the government, urban development and social stability and unity reaching abuses.This paper intends to use the index case analysis, and select the cases of corruption in the field of collective land housing levy which were investigated by discipline inspection organs of district B of Nanjing from 2008 to 2013. These cases compose into a case library, by analyzing which the main features and performance in the form of corruption cases are summarized. Through the collective land expropriation in the interests of all parties associated with the role of analysis to explore the main areas of the collective land expropriation corruption occurs, for objective reasons, and perfecting the laws and regulations impose strict procedures, establish a supervision system, strengthen the livelihood security of several put-forward ideas and suggestions to prevent and curb corruption occurred. The main content of this paper includes three aspects:1. Concepts. Including the elaboration of the collective land expropriation and corruption are two concepts. First, the concept of collective housing levy land, nature, subject, object are summarized, especially the interests of all parties in the collection and the relationship between each other are analyzed. Second, the definition and characteristics of corruption were summarized. And there are analysis of China’s current collective land expropriation area status and corruption in the housing exposed manner, so as to have a comprehensive and clear understanding of the collective land on the housing levy corruption.2. Phenomenon. Through the detailed analysis of each case of corruption statistics index system construction of the case base, from the personnel work, methods of crime, corruption, the amount of money involved, link latency, sentencing and other aspects, the main characteristics of corruption in the field of land and housing levy collective were summarized, found in the form of corruption and bribery, fraud, malfeasance crime in three aspects, and the harmfulness of corruption are analyzed. Based on the analysis of the phenomenon, and carries on the discussion to the reason of corruption from the ideological and moral, the abuse of the system, mechanism, lack of supervision and other aspects.3. Suggestions. Based on the analysis of the phenomenon, considering the prevention and containment of the expropriation of buildings on collective land area of corruption from three aspects. One is to perfect the collective land expropriation system, called on the national level, local level to accelerate the legislation, the reasonable definition of public interest, the power caging system; two is the perfect compensation mechanism, mainly based on the reasonable compensation standards and the collection process is open and transparent, especially to be imposed on the right relief channel smooth, play a good administrative mediation, adjudication, judicial final hearing and different mechanism; three is in the construction of anti-corruption punishment and prevention system in the levy, with the basis of practical experience which made by district B, the specific measures are put forward as to highlight the punishment and prevention simultaneously and to strengthen the supervision and control and case investigation.
