Basic Medical Insurance Payment System Research Based On The Perspective Of Administrative Law

As an important part of social security system, basic medical insurance is of great significance to the residents’life and the development of society. The basic medical insurance system has been basically established in our country. In recent years, it has achieved initial success in alleviating the burden of urban and rural residents to see a doctor which is always seemed to be difficult and expensive. However, there are also many problems in our basic medical insurance system, such as medical expenses control pressure, difficulty in regional medical insurance.Managed by different administrative departments, the relationship in basic medical insurance is complex, which leading to the lack of uniform standard and different essential insurance medicines list. The reason is that the legal relationship between the basic medical insurance is complex, involving a large population and complicated interests. Basic medical insurance involves multiple legal relationships, not only civil and commercial contractual relationships, but also the administration. The two branches of law intersect in the basic medical insurance and take effects, in which the administrative law is oriented. Involving the life and health of all the people, the health-care reform and the allocation of medical resources, there are many hot spots and difficult points. And basic medical insurance plays an important role in linking medical system.On the basis of sufficient study of the basic medical insurance system of Germany and Taiwan, this essay aims to analysis the payment system of our basic medical system by the field of administrative law. Through the analysis of the nature of the basic medical insurance and the legal relationship under the payment system which includes administrative branch, medical insurance administrative agencies, medical institutions the insured’s analysis, as well as some debatable social hot spots, I will make some suggestions to the health care reform, which will contribute to our basic medical insurance system.
