Study On Protecting Of Right And Interest Of Migrant Rural Workers’ Based On The Survey Of Chengdu Foxconn Technology Park

Migrant-workers make great contribution to the development of economy and society for our country, and as an indispensable power for China’s economic, political and cultural construction.However,Thegroups, a huge number, contributing to national construction,are still in position to the edge of the city.They cannot enjoy treatment equal to urban residents, whose the legitimate rights and interests cannot get effective guarantee, This circumstancenot only affects the realization of social fairness and justice, but also become stumbling block in the process of building a harmonious society, which must be solved. Coordinate with the rapid development of industrialization and urbanization, The problem of the rights and interests protection ofrural workers also have changed.Chengdu Foxconn technology group, located in the west of chengdu high-tech export processingzones(PI county),thefactory covers an area of 10 square kilometers, serving approximate 80 thousands employees, mostly of staff are migrant workers. For year, there are manyreports of foxconn, mostly involves the problem of migrant workers, whoserightsareaggrieved.According to our hands-on practiceinfoxconn,studythe problem of the protection of the rights and interests of migrant workers, and we make the corresponding conclusions. This practice is based on workers’real life as the research background,the events of rights infringement as the material.Full-text consists of five chapters.The first chapter is the introduction, mainly to clarify the background and significance of the topic, review of dynamic and abroad, study ideas and methods, as well as innovation and shortcomings of the paper. The second chapter is the theoretical foundation of knowledge, mainly to explain the concept of the migrant workers, the new generation of migrant workers and their rights and interests. Subsequently cited theory of justice, Maslow’s theory, traditional philosophy to provide theoretical support for the following questions analysis. The third chapter summarizes the current situation of rights protection process to the migrant workers, then we figured out the problems in the process of protecting the migrant workers rights and interests. The fourth chapter is summarized, studied and analyzed the protection of rights and interests of migrant workers. The fifth Chapter, we obtained the ideas and ways to protect the rights of migrant workers.The main conclusions are as follows:(1) Overall, the interest of our migrant workers has improved nowadays, but there are still have some problems in the aspects of rights, mainly in the employment, personal safety, the politics and political dignity. In a word, they are lack of social security rights and social identity.(2)According to analyzing the different factorswhichmigrant workers’ rights and interests protection.we find that the root cause of migrant workers’ rights and interestsdamaged is city and countryside binary household registration system andemployment system. An important cause ofinigrant workerscannot get due equities isweak awareness of the law, and even the lack ofconsciousness. The key factor for Migrant-workers rights damaged is government not played the corresponding protection,beside the legal unsound. The direct cause of lead to migrant workers’ rights and interests damagedis inequality of the labour market, the imbalance of supply and demand and enterprise lack of responsibility.(3)Because of migrant workers’ rights and interests is complexity and difficulty,, need for government, enterprise, society and the joint efforts of workers themselves and other related subjects, establish a comprehensive and coordinated system of migrant workers’ rights and interests safeguard policy, in the process of safeguard legal rights.
