The Research Of Perfecting Our Immigration Legal System

With the intensification of international competition, the world has accelerated the pace of competition for talent.The United States,Russia and other countries have modified immigration policy to attract talented people from all over the world,making the international talent competition more serious. Skilled immigrants are an important part of talent resources around the world,so developing a more competitive talent attraction system is an important goal of legal system construction in our country.In order to sharing more dividend of "the world immigrants ",in recent year,laws of overseas talent related in our country has made significant progress.But,at present, law system of technology immigration in our country still have many shortcomings.For example,when we issue talent visa(R visa) for foreign talent, it’s hard to determine what kind of skilled immigration is need.At present, we often use "significantly", "shortage", "famous" and other words to evaluate the introduction of talent. Although our country have established the talent visa, our country has not build all kinds of system to matching with talent visa.We have not set up the labour market test system, integral system, professional listing system and so on.Although China established the exit and entry administration law in 2013, the new law didn’t innovate a lot.The law only pile up laws and regulations,and didn’t keep with the advanced experience in the legislative thought and legislative technology.In the introduction of foreign talents, our country’s attitude is too conservative.So we still need to perfect the law system of technical immigration in our country.First, this paper discuss the necessity and feasibility of perfecting legal system of skilled immigrants. Then introducing the skilled migration laws and legal systems in typical immigration countries such as the United States,Canada,the British and Australia. The next part explores to establish skilled migration law and related legal system that suitable for the actual situation of our country.The legislative purpose of technology immigration law should be insisting on developing national economic,maintaining national interests.We also should be properly balancing the interests between the immigrants and the country.Then we will realize the development right of nationality and individual.When making technology immigration law, we should stick the principle of encouraging introduction, supplement insufficiency, taking the market as guidance.There are many places that need to be perfect in the construction of technical supporting legal system.We should be established including but not limitedto the independent skilled migration system, labor market test system, skilled migration occupation list system, integral evaluation system, integration, system, etc.
