The Research Of Letter Petition System Problems And Crack Path

At present,the current state of the law in general is in a conprehensive deepening of refore.As a supplementary petition for judicial relief, it’s operating mechanism syst em needs to be improved. Petition system is to allow people to express their opinions and suggestions through a simple procedure, to set up a bridge between the masses an d the government. This year, with the economic development, social transformation, t he interests of diversification, has brought the social contradictions or disputes, the pet ition system is facing problems and challenges in practice. Taking LeLing as an exam ple, this paper focuses on the research of China’s petition system, analyzes the proble ms existing in the implementation of the system of letters and visits, and puts forward some countermeasures and suggestions for the existing problems.The research on China’s petition system and the regulations on letters and visits, c ombined with in recent years, our country’s actual situation, LeLing in Shandong Prov ince as an example, and with reference to foreign letters and visits system experience,from five aspects of the letters and visits system function, system, accrual, mechanism and evaluation, analysis of signal to visit problems existing in the system and the stat us of the implementation process and the resulting effects, try to explore the petition s ystem which is suitable for national conditions of our country of the crack path.In practice,the research has a bold vision.Such as the establishment of unified pe tition and acceptance in the work of the masses to national authorities and the national staff reflect, request for proposals, opinions or complaints, of litigation cases, once in the judicial process and the referee results shall not restart the petition process, only inaccordance with the provisions of the procedural law of the procedure for trial superv ision error correction or maintain, in this way, the petition system can not only continu e to serve as "relief valve" for the social stability,but also can play the role as the wind indicator,guide the letters and visits system set up to the objective value.
