Study On The Organization And Management Of Communitv Correction In China

Community correction is a kind of non imprisonment penalty execution system, which refers to placing the criminals who meet the conditions of community correction into the community, within the time limit of judgment, ruling or decision, to correct their crime psychology and behavior habits and help them smoothly integrate into society by special organs and under the assistance of relevant social groups and non-governmental organizations and social volunteers. Simply, it is to allow criminals who meet the conditions of community correction to execute their penalty in community.In recent years, with the deepening of community correction, although it has achieved some success, there are still some problems such as the management system is not smooth, insufficient work force, and low social participation. Dongying City began to explore the implementation of "3-44" educational supervision model from 2011. "3" refers to the construction of "three teams":the team of law-executors, the team of volunteers and the team of psychological counseling, "44" means 44 community correction services, as well to expand the team construction, which walking in the forefront of the province in institution building. At present, Dongying City Community Correction organization and management has gotten some results, but there are still huge exploration space, and also has certain value for studying.Therefore, this paper tries to analysis problems and reasons of community correction organization and management, taking Dongying City as the research object, integrating experience and enlightenment in various regions, and puts forward countermeasures and suggestions to promote the development of community correction organization and management.At the beginning of writing, I referred to a large number of documents, reserving a more adequate theoretical basis and I carried out field survey and research on the status of community correction in Dongying, which laid foundation for research.The paper uses combined methods of theoretical analysis, field survey and research, case analysis and comparative analysis, analyzes problems and causes existing in organization and management of community correction by combing with the related basic theories, analyzing of status and operation mode of Dongying community correction and contrasting & referring experience and enlightenment of domestic and foreign advanced areas.In conclusion, authorities at all levels of Dongying City lack attention to community correction and there are some problems such as fearing of difficulty and avoidance in the process of advancing. The overall quality of community correction team is not high, business ability is not strong and professional level is low owing to a short time of promotion and restriction of organization and management. Restricted by urban development and citizen consciousness, the participation of all kinds of social forces in Dongying city is not enough, and there is a phenomenon of excessive government leading. There are some other problems such as work thinking is not open enough, pace of innovation is not big enough, protection and incentive mechanism for all kinds of personnel are not formed and sense of exploration is not advanced enough. For those problems, it is necessary to explore the establishment of community correction officer system and establish operation mechanism which national staffs with law enforcement qualification as the main body by summarizing and drawing on the advanced experience at home and abroad; to develop and expand service of community correction social workers and volunteers and actively absorb the social forces to widely participate in; to give full play to supervision and guidance of judicial administrative organs and social circles and make coordination mechanism with relevant departments perfect, which ensure that the community correction system is actually execute in place to achieve more with less.
