Historical Changes Study Of Chinese Communist Party Regulations

On 4th plenary session of 17th CPC Central Committee, the Chinese Communist Party puts forward to the proposition and task of improving the scientific level of party building. Since then, they continuously push forward party building. Besides, building and studying regulations of the party attracts increasing attention. The effective operation of any modern political party can not work without rules and regulations, especially for the ruling party. Party ruling is the premise of ruling a country. Party ruling should be done in a strict way, and this way requires regulations and discipline. Party regulation has been continuously developed and improved in the historical practice of the Chinese Communist Party. It’s now the core of Chinese Communist Party institutional system, laying the foundation for governing the country and the long-term ruling. On 18th National Congress, the party has comprehensively promoted the rule of law to adapt to the development of law modernization, further enhancing the level and height of the rule of law. Party Laws and Regulations has been strengthened from comprehensively promote the rule of law’s point of view on 4th plenary session of 18th National Congress. It has been proposed that ruling and managing the party and constructing the socialist country ruled by law should be done on the basis of the party rules. On the background of rule of law and governance modernization, it’s no doubt that the construction of Chinese Communist Party regulation is not only an important content and way for them to strengthen party’s building, but also an effective protection and urgent requirement for the implementation of the ruling by law strategy and legal administration way.Based on the historical practice of the Chinese Communist Party regulations and combined with the global, national, party situation, this paper constructed the analytical framework of the party regulations’ change since the establishment of the party. We accomplished this issue from the perspective of historical institutionalism concerning the origins and system changes. Approximately same as Chinese Communist Party’s development path, we divided the evolution of party regulation into three periods:bud formation period, continuous development and tortuous exploration period, enriching and improving period, which corresponds to the birth of Communist Party of China, the founding of new China and 3th plenary session of 11th National Congress. Research shows regulation and institution change’s occurrence of the party is influenced by power configuration, old system, political environment, new ideas and key actors synthetically. There exists two forms of path dependence in the party regulation’s evolution, which are positive increasing returns and negative path locking. Short-term returns’ increase and long-term returns’ diminution on the party rules and regulations mainly reflects in thinking highly of substantive regulations while slighting procedural regulations and party rules and regulations legalization blocked by solidifying of traditional culture model. Besides, the long-term lock of party rules and regulations’ positive feedback effects mainly reflects in three effects:constitution position highlights and consolidation of democratic centralism, party political authority’s stepwise progressive and transition, party integration and its gradually improving ability to integrate the society.Since the 18th National Congress, Chinese Communist Party’s understanding in managing state affairs has updated to a new height. They put forward the strategic layout of "building a moderately prosperous society, comprehensively deepening reform, and comprehensively promote the rule of law, overall tightening party discipline". Under the new situation, Chinese Communist Party needs to attach great importance to party regulations building, positively break negative path dependence on party’s regulatory developments, inherit and innovate positive path dependence, consciously explore a party regulations construction road with the specialty of China and the characteristics of the times. In the new historical period, party regulations should use constitutional way of thinking on value concept. The rule of law’s concept within the party should be formed. The CPC should also use Chinese Marxism and to guide the party regulations. They should conduct the system construction adhering to the party constitution as the fundamental and democratic centralism as the core. Besides, the party needs to handle the relationship between national laws and inner party regulations, in order to achieve both organic link. In practice mode, the party should strengthen top-level design and overall planning, scientifically allocate power within the party, improve the formulation inner-party regulations and enforcement mechanisms, strengthen the implementation and promote scientific and long-term development of the party regulations.
