Research On The Legal Relations Of The Genetically Modified Food Labeling System

The advent of genetically modified food (GMF) has solved the problem of food shortage of the human society, but it also has brought major source of potential safety hazard. Because the current level of science and technology cannot guarantee the risks of GMF, there are still concerns on the safety of it, so the labeling system as a connection of GFM and consumer has been produced, and it got the favour of many countries, they have established labeling system to regulate the GMF. In recent years, although our country has established a relatively perfect regulation system of GMF, there are still a lot of shortcomings. In the increasingly fierce competition in the international situation, our country should actively study and make use of relevant international rules, to perfect our legislation of GMF, actively perform international obligations to improve our country’s international influence and competitiveness.The first part of this article starts from the concept of GMF, illustrates the controversy about the safety of GMF, including the influence on ecological environment and human health. Then introduces the concept of the labeling system of GMF. Then introduced such problems of the labeling system as the classification, the range and threshold. Then puts forward the significance of the labeling system’s implementation including the maintenance of consumers’ right to know, and the risk prevention and to promote the development of the market.Then respectively introduces relevant provisions of the labeling system of WTO, multilateral international treaties and international organizations. And summarizes the current international society’s attitude toward GMF labeling system.The third part introduces the mode of labeling system of GMF of the United States and the European Union through legislative philosophy, legislative stipulates and supervisory subjects. Summarized the differences in legislation of international rules of each country and the cause of it.The first place of fourth part introduces the legislation of Chinese labeling system of GMF. Then combined with the international rules, author further analysis of the defects in the legislation of it. Then puts forward suggestions on the improvement of the labeling system of GFM.Bold assumptions and suggestions are put forward to build a regional labeling system of GMF at last.
