Research On The Legal System Of Genetically Modified Food Labeling And Its Improvement In China

The widespread application of genetically modified technology in food manufacturing industry has made Genetically Modified Food become an important part of people's dietary culture gradually,but the safety issue has been unable to be accurately responded to.Consumers awareness of rights has been strengthened gradually,the calling for knowing the information of Genetically Modified Food is increasing.In order to protect consumers' rights and interests,and to prevent the risks that Genetically Modified Food might bring to life,health and environmental safety,governments have built Genetically Modified Food regulatory system based on their own national conditions,and the Labeling system is the key part.In 2002,China started the process of regulating Genetically Modified Food Labeling at the legislative level.After decades of legislative exploration,a compulsory Labeling legal system based on the Labeling Management Catalogue has been formed.But in practice,there are still some problems such as lack of specialized legislation and labeling rules,the failure to update the Labeling Management Catalogue in time,and the imperfect regulatory mechanism.The advancement of science and technology makes the existing legal system of Genetically Modified Food Labeling insufficient to cope with the new situation in the market,so it is urgent to improve it.This paper studies the legal system of Genetically Modified Food Labeling in China.Firstly,it clarifies the basic concepts involved,analyzes its legal basis,and explores the relevant conflicts of interest and balanced relations.Secondly,it finds out the shortcomings in the current legal system of Genetically Modified Food Labeling in China by sorting out and analyzing the current domestic relevant legal norms and judicial practice.Finally,the relevant legal systems of typical countries or regions such as the United States,the European Union,Japan are analyzed to find out the parts which can be significance referred to,and after fully considering the national conditions of our country,corresponding suggestions that can be referred to are put forward from the following three aspects:First,in promoting the standardization and unification of the Labeling system,the author suggests to formulate the special legislation of Genetically Modified Food Labeling,define its legislative adjustment,and at the same time,the protection of consumer rights and interests shall be limited within a reasonable range;Second,in terms of perfecting the content of the labeling rules,the author suggests updating the current catalogue of labeling management,introducing threshold provisions,standardizing the form of labeling,and adding provisions on non-Genetically Modified Food labeling;Finally,with regard to optimize the regulatory mechanism,the author recommends the main body of supervision and the division of functions should be determined,the publicity of supervision information should be strengthened,and the traceability system and punitive compensation mechanism should be introduced.
