Research On Legal Issues Of The Genetically Modified Food Labeling In China

Genetically modified plants first entered the market in the mid-1990 s,and soon after that,genetically modified crops began to be grown commercially.Since then,genetically modified food has gradually entered the life of ordinary consumers.Genetically modified foods have played an important role in solving global food security and other issues and made significant contributions to agricultural development.Genetically modified food is a double-edged sword.Compared with traditional food,genetically modified food has the advantages of large yield and high nutrition.However,due to various risks,genetically modified food also has a lot of controversy after its appearance.It is difficult to fully determine whether genetically modified food is harmful to human health,which has caused many consumers' doubts.The unequal status of information between producers and consumers has exacerbated such doubts,and even further caused consumers' panic over genetically modified food.Great science and technology should not be stopped by disputes.Safety supervision is the right attitude to benefit mankind.In view of this situation,governments of all countries adopt their own regulatory measures for genetically modified food based on their national conditions,and construct a management system including the genetically modified food labeling system,which can protect the legitimate rights and interests of consumers and promote the healthy,orderly and stable development of the genetically modified food industry.At the beginning of this century,China gradually began to regulate the safety of genetically modified food,including the relevant labeling system of genetically modified food.At present,a system has gradually formed.Although system of gm food has been in the country,there are different levels of laws and regulations to support the implementation of the relevant systems,but always because of imperfect legal system affect the regulation of maneuverability,because of the supervision mechanism is not sound caused chaos in the regulation,because of incomplete identification system is effective supporting system play a regulatory role.These problems in the genetically modified food labeling system will not only have a negative impact on the law enforcement of government departments,but also directly affect the judgment of the case when the public safeguard their rights through judicial means on the genetically modified food issue.This may increase the difficulty and cost of consumer rights protection,and further increase the public's resistance to genetically modified food.This situation is very unfavorable to the protection of the legitimate rights and interests of consumers and the maintenance of normal market economic order.In view of the legislation and judicial practice of genetically modified food labeling system in China,this paper summarizes the relevant laws in China,selects several typical cases,and divides them into three categories according to different natures for case analysis,so as to find out the problems of genetically modified food labeling system in China.At the same time,the relevant foreign legal system is summarized and analyzed to find out the reference part,so as to put forward the corresponding legal improvement countermeasures and Suggestions from three aspects on the basis of China's relevant legal provisions,forming chain supervision.In terms of improving the labeling rules,the author suggests to add special genetically modified food labeling clauses,improve the scope,form and content of labeling,and establish scientific and reasonable labeling rules.In terms of the establishment of regulatory legal system,the author suggests to clarify the regulatory subject,strengthen information disclosure,avoid local protection,and make the labeling rules operate efficiently.In promoting the construction of legal system of punishment and relief,the author proposes to strengthen the punishment for violation of law,introduce traceability system,improve the relief system,and make the genetically modified food labeling supervision have enough deterrent force.
