Research On Legal Issues Of Identification Of Genetically Modified Food In Our Country

Since the end of the 20 th century,with rapid development of modern biological science and technology,Great changes have taken place in people's production and life style.It has made a lot of food production and also made economy got rapid development.According to statistics,since 1996,the planting of genetically modified(gm)crops has reached 2 billion hectares in the world.However,there is no consensus on the safety of genetically modified foods in the scientific community.There are many countries and regions begin to implement the system of identification in order to ensure the consumers' right,and also to protect the market order of genetically modified foods to be effectively regulated.In 2002,the Ministry of Agriculture issued the "regulations on the administration of agricultural genetically modified organisms safety".This Law stipulates that genetically modified foods need to be identified,and in the same year issued a mandatory identification dialogue.With the rapid expansion of the market of genetically modified food,the existing identification system has been far unable to meet the needs of the development of reality.At present,a lot of genetically modified food has not been modified,and also has not form a unified standard.Some of the label is too small to find,Some foods are labeled “non GMO”,“no use of biotechnology” or other words.These phenomena are due to the imperfect system of genetically modified food labeling.The law does not make specific and definite provisions on the standards,objects,scope,qualification and standards of identification,which results in the lack of operability in practice.Therefore,this paper combined with China's specific national conditions and puts forward some measures and suggestions to improve the identification system.This article is divided into four parts:The first part mainly discusses and analyzes the background and necessity of the identification system of genetically modified food in china.Firstly,using the chart to introduce situation of GM crops and genetically modified food and its future trend.Secondly,according to the research and experimental data of scholars and experts,this paper analyzes the possible harm to ecological environment and human health.Finally,it summarizes the theoretical basis and practical significance of the identification system.The second part mainly analyzes present situation and problems of China's GM food labeling system.Firstly,it introduces the legal provisions of China's identification system.Secondly,analysis the identification on the market situation,and the related cases.Finally,analyzes the problems existing in the identification system.The third part mainly discusses the foreign genetically modified food labeling system.Firstly,introduces several typical foreign identification system.Secondly,this paper compares and analyzes different kinds of identification system and its causes.Finally,this paper discusses the Enlightenment of foreign identification system to our country.The fourth part mainly discusses the countermeasures and suggestions to improve the labeling system of genetically modified food in our country.Firstly,we need to improve the legislation of our country.On the one hand,it is necessary to establish the principle of prevention and the principle of the supremacy of consumer rights,and to establish a special labeling system for genetically modified foods.On the other hand,it is necessary to strengthen the supervision of the identification system,improve the regulatory functions,establish the whole process tracking system.Secondly,it is necessary to improve supporting measures of the labeling system,the detection system of genetically modified food,including testing standards,qualification of testing institutions,testing procedures and testing methods.Finally,the establishment of genetically modified food labeling system requires extensive participation of the public,including publicity and education,popularization of relevant knowledge,etc.
