Study On Regulation Of Civil Servants Taking A Part-time Job Or Holding More Than One Posts

The article takes the Huang Zhengyao Event, which has produced a wide range of effect in society, as a breakthrough point of the main topic——regulation of civil servants taking a part-time job or holding more than one posts. By analyzing and evaluating the Huang Zhengyao Event, pointing out the problems in regulating civil servant being pluralistic. And then this thesis sums up the two dilemmas of the regulation——defects of legislation regulation and difficulties in practice operation. And then analyzes the dilemmas of the regulation and draws a conclusion that the predicament in regulating the civil servants’ behavior of taking part-time job mainly results form the special policy at the early stage of reform and opening-up policy, the double attributes of civil servants part-time behavior and the drawback of the management regimen of civil servants. On the basis of summary of the dilemmas and causes, this article puts forward several suggestions and countermeasures to deal with them, both from normative and practical aspects, such as such as the basic principles of legislation, the forbidden scope of pluralistic behavior and the content and intensity of investigation.
