Application Research On Applying Case Study Method In Community Correction Of Juvenile Violent Crime

In recent years, the incidence of juvenile crime in China stays in a high level, and the crime becomes more low-aging and group behaviors. The most frequent crime includes robbery, theft, i ntentional injury, school violence, and group fight.The increasing rate of juvenile crime carries t he important topic out, how to decrease the rate, or even more important, how to prevent juvenile crime. As to juvenile criminals, Chinese criminal law has different attitude from adults in probat ion and community correction to protect juveniles. Unlike adult violent criminals, juvenile crimi nals could get probation and community correction because most of them are immature in their p sychology, physiology and thought, and lack of discrimination and self-control abilities. It is imp ortant to distinct the adult crime, juvenile violent crime and light juvenile crime.This thesis discussed a juvenile crime correcting case of xx Judicial Institute of Wuhan City. Using case study method from different angles, based on psychological and physiological immat urity of juvenile, this thesis developed a combine method including both family correction and c ommunity correction, effectively found out the factors which lead to crime, made intervention an d offered help to the juvenile criminal. Then this thesis analyzed the benignant changing process of the criminal from different aspects.With the re-interview to the young person, this thesis discussed the short slab of current co mmunity correction, and gave specific improving suggestions. Light j juvenile crime, juvenile vi olent crime and adult crime should be treated differently. Specific and normalized personal files should be built. Based on the dynamic psychology status, criminal’s age, family status, and cause s, the juvenile criminals should be ranked, and different correcting blue prints should be consider ed for each rank. In this way, the social community correction could likely achieve significant su ccess, and hopefully the juvenile crime rate could effectively decrease, and more juvenile crime could be prevented in the beginning.
