Viewing The Relationship Between Rural Government And Village Committee From Villagers’ Self-governance Regulations

Villager autonomy is the great progress of China’s democracy at the grassroots level development process, the most significant change caused by this policy is the relationship between the township government and the village committee, the previous relationship turned the upper and lower levels into a parallel relationship. If only put a simple modification on the definition of the relationship between towns and villages, but keep the original arrangements as the same,then the policy effect must be minimal. However, there is such a problem in practice, the villagers’ autonomy in China gradually degenerate into the passive democratization process which is driven by administrative power, the relationship between rural government and village committee have also exposed the drawbacks of administrative tendency. The ideal village governance system is not only the redefinition of the relationship between the towns and villages, but also make the detailed provisions of the boundaries of government and village affairs and content of villager autonomy. Even though the most authoritative Village Committee Organization Law of the current village governance system and the other relevant laws and regulations are not included in the content, the villagers’ Autonomy Law is lacked. The villagers’ self-governance regulations are formulated by the villagers spontaneously, the contents are related to the daily management of village affairs, if the villager self-governance law has not yet appeared, it should play the role of the villager self-governance law, but its significance has always been neglected.Therefore, this study takes the villages’ self-governance regulations as the breakthrough point, it will help us deepen the understanding of the current rural relations,to explore whether the villagers’ self-governance regulations can promote the rural relation which is administrative, and in order to provide reference for the future promotion of the rural relation. Therefore, this study selects a sample of town, focus on the interactive process between the village committee and town government of the formulation and implementation of the villagers’ self-governance regulation, combined with the text analysis of the articles of association of the villagers’ self-governance regulations, make use of interviews, questionnaires and text analysis in the empiricalstudy. The final conclusion of this paper is that the process and the content of the villagers’ autonomy regulations in the sample town can not embody the self-governance,because there are administrative problems in the current rural relations, the villagers’ self-governance regulations are produced under such background, its autonomous components are greatly compressed, so, conversely, the villagers’ self-governance regulations can not play a role in getting rid of the administrative rural relations.
