Around the world,Minors crime is always a serious social problem. The researchabout Minors crime gradually came into the leading edge of theory circle in recentyears. On March14,2012, the National People’s Congress officially passed theamendment of the criminal procedural law, in which the minor criminal procedurewas provided in the chapter five. This is a response practical field made to theorists.In this context, the empirical study of Minors crime is necessary to prevent andcontrol Minors crime and promote the development of Minors criminal theory. WhenI interned in the People’s Procuratorate of Fuling District, I investigated and collecteda lot of practical materials and information to complete the writing of this article.The article mainly uses three methods, including statistical analysis, caseanalysis and interviews with law. The author investigated current situation of Minorscrime of Fu Ling District from2003to2011. The data used in this article is based onstatistics of the public security organ,the state procurators and the court. It shows usbasic picture of Minors crime and judicial practice situation in this district. And thereasons of minors crime will be demonstrated. On that basis, starting with the policyof the protection of minors, the article proposes some pertinent countermeasures andsuggestions to hope to be useful to the prevention and control of Minors crime.With a total of30000words, the article is made up of six parts.Part one is a preface. The preface briefly reviews the article’s studying methods,research purpose, research significance and research ideas.Part two introduces the current situation of Minors crime of Fu Ling District,including general trend, fundamental rules of types of Minors crime. The quantity ofMinors crime in Fuling District become stable gradually and its proportion decreasesslowly. Crime types are concentrated in crimes against property and violent crimes.The pattern of crime shows diversity. For crime subjects, farmers and unemployedoccupied a higher percentage. Low culture and the trend of younger age are the othertwo features. It offers an outstanding characteristic of gangs. Criminal means becomemore violent and a sign of adult appears. Most of crimes are premeditated whilecriminal motives are casual. Part three analyses the reasons of Minors crime in Fu Ling by the method of casestudy. The causes of the minor crime are various and complicated, including factorsfrom family, school, society and the minors themselves.Part four dissects the judicial status of Minors crime in Fu Ling. How to dealwith minors crime and its problems will be elaborated in investigation stage,prosercution stage, trial stage and execution phase.In Part five, the author comes up with a series of strategies and advice for theprevention and control of Minors crime, including social prevention and justice of theminors’ crime. Social prevention system of minors crime which is focus onun-happened, is made of family, school and society. While the judicial systemcontains judicial philosophy, judicial organization, judicial institution and process,which face already happened.Part six are some conclusions made on basis of this empirical research. Minors’crime can be controlled.The prevention and control of minors crime is a complex system, because thefactors which induce crime are complicated. The whole society should work for along time to build rigorous prevention system, which is used for eliminating thefactors that may cause crime. When the judicial process cannot be avoided, we shouldsolve the various problems in the judicial practice and improve the mechanism ofjustice as possible as we can. Only this can we achieve the purpose of preventing andreducing minors crime.
