Employment is the foundation of people’s livelihood. China, as a developing country with a population of one billion three hundred million, is facing the abnormal complex and rigorous problem of employment. The party and the government have paid more attention to the employment problem. Then, they regard it as the most important event to improve people’s livelihood, push economic development and promote social harmony. One of the major ways to promoting and stabling Chinese employment is vocational training, which is also the fundamental measure to the government to solve the structural unemployment and plays an indispensable role in Chinese economic and social development. Only within the standard and bounds of the law can vocational training keep continuity and stability development.At present, there are many relevant laws and regulations of vocational training in Chinese. Legislation system on vocational training has initially taken shape in our country. At the same time, we have achieved some successes and also accumulated valuable experiences. However, in general, the government is mostly the dominant parts of the legislation activity at present in our country. Vocational training laws which have been announced, have more advocacy advice than mandatory provision. Then, it is also lack of supervision and feedback in law-enforcing. For this reason, the implementation effect of vocational training law is not as satisfactory as it might have been and the developing of vocational training is also limited to some extent.All this time, the western developed countries have always been focusing on vocational training and their vocational training legislation system has been already relatively perfect, among which stand out the America and Germany. The former is the world economy powerful nation, and the latter is world renowned for its dual-system vocational training. Both of them started to explore their vocational training legislation as early as one hundred years ago. They have been already set up a set of more perfect legislation system of vocational training and also have accumulated many experiences.Based on the relevant text research, through the comparison and analysis of the vocational training legislation among China, America and Germany, the author provides a set of reference on vocational training legislative perfection in our country. It includes four sections:Firstly, the paper introduces the research motivation and meaning, determining the research thinking and methods by presenting the research status review, then defining the related concepts. Secondly, the paper combs the vocational training development vein through consulting the data of the vocational training among China, America and Germany, sketching out the forming and development course of the vocational training among these three countries. Thirdly, it summarizes the characteristics of the three countries by comparing their vocational training legislation on the subject, content and procedure part. Lastly, through analyzing their different characteristics, it reviews the insufficient of the vocational training legislation in our country, drawing some suggestions about how to perfect the Chinese vocational training legislation, like improving the legislation subject, revising the legislation content and adjusting the legislation procedure.
