Research Of Embeddedness On Social Work In Judicial Mediation

Nowadays, social work has not entered the judicial mediation system of China yet. Whereas the coincidence between them, which includes value, essence, functions and basic principles,makes the embeddedness possible. It is not only a further advance for the reform of China’s traditional judicial mediation system to integrate social work into judicial mediation, but also the further expansion for social work in a new field. If the social work and judicial mediation could work together, law cases can be solved with high efficiency and quality, which can also promote social harmony and stability.Combined with my experience of civil trial work before I attended graduate school, as well as knowledge and skills I have learned during my study at graduate school, I have practiced in YQX People’s Court in Taiyuan as social worker and used social work individual case method to serve both parties in civil dispute cases person-to-person. During the whole service process, I have found a lot of questions through the participation of judicial process as well as the observation and assessment of both parties in a case. The process of participation contains the pre-litigation mediation, pre-trial mediation after register, trail in court, and after-court mediation. At the interval of the case, based on my objects I have got involved in the both parties by face-to-face communication individually, then established trust relationship to open the mouth of the case subjects about some important information, then guided their emotions as well as thoughts in order to promote solving the dispute at the process of judicial mediation. The case interval involves the time between after register and before mediation, before mediation and trial in court,trial in court and mediation after court. The intervention process at the interval of the case contains participation and intervention during the whole lawsuit process, and the introspection of advantages and disadvantages of individual case method in the judicial mediation.On the one hand, this paper further develops the application study of embeddedness on individual case method of social work in judicial mediation; on the other hand, this paper emphasizes the significant role that the localization of social work in courts plays in the pluralistic society period.
