With the further development of integration of urban and rural areas of our country,rural land transfer problem not only relates to solve China’s “three rural issues”, but also affects the development of China’s urbanization process. Development, and vigorously promote the modernization of agriculture in urban and rural areas under the background of rural land transfer, standardization, legalization be imperative. Through the research results of domestic and foreign about rural land transfer problems were collated and summarized, to take the field investigation and consulting experts and other methods, the related concepts and theories of China’s rural land transfer of the sort, historical evolution and the necessity of rural land transfer in China are discussed, on the transfer of the rural land in our country present situation and characteristic of the in-depth analysis.At the present stage our country rural land transfer scale is increasing year by year, the rural land transfer form gradually diversified, subject participation of rural land transfer gradually rich, and constantly enhance the legal awareness of the transfer of rural land in the process of farmers. Although the Chinese government has provided the necessary policy support for rural land transfer, but the policy is still not perfect, the transfer of rural land transfer behavior was not standardized, there are still large scale management degree is not high, the existence of non agriculturalization of land transfer after the non food and other issues, these problems have seriously affected the healthy development of rural land transfer, not conducive to the maintenance of peasants’ rights and interests, resulting in adverse effects on the construction of agricultural modernization in china. Investigate its reason, the relevant laws and regulations of the transfer of rural land is not perfect, the lag of the construction of rural land, rural land transfer service security system after the lack of appropriate performance appraisal mechanism, aiming at these problems, this paper puts forward three suggestions: first, the establishment of the relevant legal system and perfect the rural land transfer; second, establishing and supporting service guarantee perfecting the system of rural land transfer; third, establish and perfect the rural land transfer performance appraisal mechanism.
