Land transfer is an objective trend of rural development,and an inventible results of rural productivity increase.In the course of land transfer,however,invasion of peasants? rights occurred occasionally.It not only discouraged peasants to transfer their land,but also impaired the process of agricultural modernization.Theoretically,Land transfer is influenced by property theory,land rent theory,institutional change and other factors.Based on the basic elements and principles of rural land transfer,we analyzed the relationship between land transfer and peasants? rights,and pointed out the necessity of protecting the peasant?s rights during the course of land transfer.First,we did field research regarding the main types of rights invasion,and investigated the reason from the aspects of present law and rural land system,the influence of market and personal understanding.Following the theoretical analysis,a survey-based Probit Model was introduced to find out the salient variables.The conclusion was conducted based on the analysis results.Finally,we put forward the political suggestions regarding system protection,routes design and risk precaution to protect peasants? legal rights.Our study presented the key elements influencing peasant?s rights in land transfer.It provided a basis for further study in rural land transfer.
